Department of Lands, I oppose the application for a commercial navigational encroachment permit, ERL95S1378B – North Idaho Maritime / John Condon, and the building/development of a commercial dock and a commercial work area on Lake Coeur d’Alene in Wolf Lodge Bay due to the negative effects the proposed encroachment will have on adjacent littoral property and public trust values such as: fish and wildlife habitat, aquatic life, recreation, aesthetic beauty and water quality.

It is the mission of the IDL to protect public trust values (navigation, fish and wildlife habitat, aquatic life, recreation, aesthetic beauty & water quality) Idaho Code §58-1301. Title to these lands is held in trust and is administered for the public benefit rather than for a specific beneficiary.

IDL is obligated to place public trust values above the economic benefit of a particular individual or small minority of community members, that is, the greater good of the public must outweigh the economic benefit of the few.

Alternative plans for the applicant include 1. Developing another commercial maritime operation in a less environmentally sensitive area on the lake and or 2. Develop an inland operation (as have 11 other dock building businesses) locally.

Land use decisions made by IDL today for this sensitive, scenic, undeveloped bay have the potential to negatively effect public trust values and the environmental health of Wolf Lodge Bay for generations to come!
