Danny Adams started this petition to Iain Duncan Smith MP and
I want to stop the injustice of the DWP PIP scheme taking Disabled Mobility cars from people unfairly. I know lots of you will stop reading now because you feel this does or will not affect you, but please read on because this could be you or someone close to you one day. Please sign this petition to stop others going through the worry and the stress we are going through. My daughter had a stroke at 39 and is still partially paralyzed, but is able to have some independence with the help of her adapted car from Mobility, which has all the controls on the right hand side of the steering wheel.  When she was assessed in 2008, she had to go through the stress of medicals and interviews, another driving test and because of the severity of her disability it was agreed she would have the benefit for life.  Especially as the stress could affect her symptoms.  Last year the new disability PIP scheme was brought in by the government to replace DLA. It was decided that all patients under a certain age had to be reassessed.  Cheryl my daughter was reassessed in January, and was two points short of keeping her mobility element of PIP and therefore keeping her specially adapted car.  She lost this because of an error by the assessor.  The next step is you have to apply for a review, then she can go for appeal.  The DWP say this can take 6 - 8 weeks, in the meantime she has to return her car, or purchase it for £9,250.   When she wins her appeal the DSS will have to adapt another car, which no doubt there will be a waiting list for, and expense.  In the meantime her only option is to either wait about 6 months or purchase the car, which she will have to sell again at a loss, as it has been overvalued, and there is no negotiation on the value.  Thousands of severely disabled people are winning the appeal process, proving the assessment process is flawed.    My aim is to stop the DWP taking cars from people until it has been proved on appeal they are not entitled to them. It has been widely reported in the press the ASOS assessment process is flawed, so we need this unjust unfair practice to stop.  Let me tell you about us…. We are a normal family, in a normal village, who have worked all our lives paid our taxes, never claimed benefits, apart now I have my old age pension.  Ten years ago my daughter unexpectedly had a stroke.  At the time Cheryl was a credit controller for Estee Lauder.   She was 39 years old, slim, fit, and a year before she had run the race for life for Breast Cancer.   The stroke destroyed her life, at the time she was totally paralysed down one side, could not speak, and it affected her mentally. Recovery has taken many years of physio therapy, psychology, lots of medical assistance, but most of all it has taken pure determination and bloody mindedness of Cheryl, and I am very proud of her recovery.  She has lots of medical issues still. She now she can walk very short distances with the aid of leg splints and a stick, but without the splints and adapted shoes this would be impossible, as the muscles in the leg are still in spasm and the toes want to curl over. So to me it is amazing she can walk at all.  It is only with great reluctance we can ever convince her ever to use a wheelchair, but it really is for her own good to save her from the struggle.  If you could only see the pain, and determination she has to have to take a single step. Her left arm is still useless, and the fingers are still cramped up in a tight fist. She has no movement in her arm at all. As you might be able to tell I am very proud of my daughter, and of her achievements but we need your help. As we have to stop DWP taking hers and other severely disabled peoples cars, until it is proven they are not entitled to them. Please sign this petition to stop others going through the worry and the stress we are going through.
