Restoration of life and liberty of a senior citizen against his son and daughter in law
Restoration of life and liberty of a senior citizen against his son and daughter in law
I Satyanarayan kurmi, s/o Late Chunilal kurmi, age 76, former central govermment employee resident at 17a Dr. K.d Mukherjee road, behala Parnashree kolkata 700060 would like to bring your kind attention towards wrongful activities of my younger son Mr. Manoj Kurmi and his wife Smt. Chandni kurmi on me and his sibling consisting of elder brother Naresh Kurmi, elder sister Babita Kurmi, married elder sister Saroj Mahato, brother in law Rabindra Mahato, nephew Amit Mahato, niece Seema Rai and son in law Manoj Rai.
For years Mr Manoj Kurmi and his wife Chandni kurmi has tortured me and my late wife Smt Kamini Devi, both mentally and physically for money and property related issues. After my retirement in the year 2004, I purchased a house in the year 2006 with my retirement bonus ( such as gratuity, provident fund and etc) under my late wife Smt Kamini devi's name. My younger son Manoj Kurmi, currently practising law in calcutta high court, and his wife Smt Chandni kurmi, wanted me to register my house at 17A KD Mukherjee road under my daughter in law Smt Chandni kurmi's name. However when I and my wife failed to do so, my younger son Manoj Kurmi and his wife Smt Chandni Kurmi started creating pressure on me and my wife in many ways both mentally and physically. This is needless to say that, reason behind such wrongful activities is money and property related greed of Manoj and Chandni kurmi which I very well understood but couldn't entertain it.
On 02.07.2006, my younger son Manoj Kurmi and his wife Smt. Chandni Kurmi with help of few localites enter my house with intention to create pressure on me and my wife to disown my elder son Naresh kurmi and elder daughter Babita kurmi and to thrown them out of my house. When I failed to do so, Manoj Kurmi with help of few localites physically abused my elder son Naresh kurmi, on the other hand his wife assaulted my elder daughter babita kurmi wrongfully infront of me and my late wife Smt Kamini devi. This incident was reported by me in Behala Police Station on 02.07.2006 in writing. After my complaint, police asked me and my younger son to resolve this matter between us mutually, as it's a family issue.
I would like to inform you that I and my late wife Smt Kamini devi has tried multiple times to resolve these difference in my family mutually. My elder son Naresh kurmi, daughter Babita kurmi and married daughter Saroj Mahato has taken good care of me and my late wife Smt kamini devi with lots of respect and with good faith, therefore I cannot disown them for my younger son Manoj Kurmi and his wife Chandni Kurmi.
My younger son Manoj Kurmi has treated me and my late wife with disrespect, he has cheated money from me through blank cheque amount Rs 75000 in the year 2005, both me and my late wife has been poorly treated, verbally abused, and threatened of physical assault by Manoj kurmi and his wife Chandni kurmi all these years. Later, in the year 2007, my younger son Manoj Kurmi and his wife Smt Chandni kurmi left my house after locking entire first floor of my premises forcefully. Between 2007 to 2008, both me and my late wife Smt Kamini devi tried multiple times to resolve this family issue with my younger son and his wife, however we were abused by them and we're also denied to meet our grandchildren's upon visit to Manoj Kurmi's house in the year 2007.
On 2nd February 2009, I registered a general dairy, number 944, in Behala Police Station to inform that first floor of my house is forcefully locked under lock and key by my younger son and his wife. A copy of this complaint was sent to Superintendent of Police Alipore and to Deputy Commissioner of police south west division. I was glad that my petition was heard by then Deputy Commissioner of police and with his assistance during 2009, I regained access of my property at 17a K.d Mukherjee road kolkata 700060 in March 2009.
After leaving my house in 2007, my younger son and daughter in law continued to mentally torture my late wife by isolating my grandchildren's from us. We tried numerous times to meet our grandchildren's, but my son Manoj and his wife Chandni kurmi didn't allow us to enter their house at all. I would like to bring your kind attention that after my younger son, his wife and two children's left our house in 2007, health condition of my late wife Smt Kamini devi started deteriorating due to shock and mental agony created by my younger son and his wife..
Now Mr Manoj Kurmi has acquired various personal loans and many credits cards under his and his wife's name from different banks between 2005 to 2007 and failed to repay them due to which many bank personals have threatened us all these years. After few years from 2007, when my son and daugter in law left our house, bank personal from recovery department started looking for them in 17a KD MUKHERJEE road. My younger son Manoj Kurmi, failed to repay his dues with them in time and never updated his new address with bank after leaving my house. Therefore for years between 2011 to 2018, frequently we have received threatening letters from various banks and credit card companies, notice like ICICI Bank money suit summon dated 2013 and 2017 from civil court under my younger son Manoj Kurmi's name where he took 5 lac loan in the year 2007 to buy car and house under his name but has failed to repay them back. This is needless to inform that banks like SBI has sent me legal notice, in the year 2018 against my younger son Manoj Kurmi's name at 17a KD MUKHERJEE road.
Somewhere in the month of November 2017, my younger son came to visit me and my late wife Smt kamini devi after 10 years. For couple of weeks he regularly visited us, suddenly one day he asked my wife to give him 2lac rupees for admission of my grandchildren's in a new school. As I have retired from service in the year 2004, it grew difficult for me to bear cost of living for 8 family member which included my younger son Manoj Kurmi, his wife Chandni kurmi and two children's. I failed to receive any financial support from my younger son all these years. Whereas my elder son Naresh kurmi has contributed in daily family expense monthly on his own will, which I have accepted on request of my late wife as a gesture of love and care.
When my wife failed to give a sum of 2lac to my younger son Manoj Kurmi, as we couldn't afford it after 12 years of retirement, my younger son scolded my wife and abused her infront of my elder daughter Babita kurmi in my absence and left my house immediately and never came back again, this caused further effect in my wife's health condition.
Now on 14 December 2019, my wife Smt Kamini devi died due to respiratory failure which resulted in cardiac arrest in her sleep at 5 am in the morning. My grandson Amit Mahato, married daughter Saroj Mahato, and I rushed to BP Poddar Hospital Alipore in an ambulance. Upon our visit, doctors at BP Poddar hospital immediately did an ECG and said that my wife died in her sleep an hour ago. Later, attending doctor at BP Poddar hospital asked me to keep my wife's death body at home for 4 hours and contact any local MBBS doctor or family doctor to obtain a death certificate. After we reached our house at 17A KD MUKHERJEE road, all neighbours and localites gathered in my premise to pay last tribute to my wife. My neighbours contacted Doctor named Abhijeet bhattacharya a cardiologist from BP Poddar hospital to visit my house. He checked my wife's dead body and declared her dead, due to respiratory failure and granted a medical certificate.
My grandson Amit Mahato, tried to establish contact with my younger son Manoj Kurmi to convey sad news of my wife's demise via facebook at 8.46 am in the morning. Now as my son left my house 12 years back, all his previous mobile numbers were unreachable. Later after searching one of my old dairies, I came across a mobile number which was actually working, I spoke with Chandni kurmi and son Manoj Kurmi and gave them this sad news myself verbally over the phone.
Thereafter within half an hour my younger son Manoj kurmi, his wife Chandni kurmi and two children's came to my house. At around 1 pm, we burnt my wife's body in presence of my both son Naresh and Manoj Kurmi, married daughter Saroj Mahato, grandson Amit Mahato, Prateek kurmi@alias Prateek Sinha and Aayushman Kurmi@ Aayushman Sinha, son in law Rabindra Mahato and Manoj Rai, nephew Suresh Routh and other from my locality.
Since 14th December 2019, my younger son and his wife again started living with us with their two children's and took possession of first floor of my house like before. On 24th of December 2019 which is soon after 10 days of my wife's demise, while performing ritual as per Hindu custom in Ganga ghat in presence of my family members, here my younger son Manoj kurmi and his wife Chandni kurmi accused me, my elder son Naresh kurmi, daughter Babita kurmi, daughter Saroj Mahato, grandson Amit Mahato, grand daughter Seema Ray, son in law Rabindra Mahato and Manoj ray with serious charges that we all murder my wife for her property, money and jewelleries.
When my grandson Amit Mahato tried to protest against these serious false allegations of murder, conspiracy and alternation of evidence, my younger son Manoj Kurmi and his wife verbally abused him and his father Mr Rabindra Mahato infront of all my family members. Later next day on 25th of December Manoj and Chandni kurmi lodged a complaint via email to officer in charge of parnashree police station stating that 8 members including me of my family murdered my wife to grab her property, jewellery and money.
Please note, we were not contacted by local police station to discuss this complaint dated 25.12.2019 until 1.01.2020.
On early morning of 31st December 2019, my younger son and his wife started threatening me, my daughter Babita kurmi, elder son Naresh kurmi of police action, court proceedings, and threatened us of arrest. When they became abusive and threatening with help of my grandson Amit Mahato, I contacted parnashree police station immediately and registered a general dairy at 11 am dated 31.12.2019 against my younger son and his wife. That whole day of 31st December 2019, my younger son Manoj Kurmi and his wife continued to abuse me, my elder son Naresh and daughter babita with flithy language and gestures. They threatened us repeatedly saying we will be jailed for rest of our life in murder charges and very soon they will throw us out of my house.
Here, our neighbours and locality people came to rescue us and asked my younger son and daughter in law to leave our premise immediately as they have failed to look after my late wife and myself for over 12 years with care and respect. My younger son Manoj Kurmi is the reason for deteriorating health condition of my late wife. Never my younger son and his wife took care of my late wife and me till today's date.
As situation went out of hand between my younger son and daughter in law, two policemen came that night on 31st December 2019, to resolve this situation, they asked me to allow my younger son and his wife to live with us as they are a part of my family, we were asked to resolve any difference among the family with discussion.
To avoid any further conflict that night among my children's, I allowed my disrespectful son and his wife to stay in 1st floor of my self acquired house.
Now, on 1st January at 10 pm, an officer from parnashree police station visited my house to inform that a case has been registered against me, my elder son Naresh kurmi, daughter Babita kurmi and married daughter Saroj Mahato, grandson Amit Mahato, grand daughter Seema Rai, son in law Rabindra Mahato and Manoj Rai under IPC 302/34. I was asked to inform all the members of my family regarding this case and to meet investigating officer on 2nd January 2020 during evening in Parnashree police station. Upon our visit to parnashree station on 2nd January 2020, I came to know that my younger son and his wife has reported that we have murdered my wife, did conspiracy to grab property and money through email to officer in charge of Parnashree police station on 25th December 2019. I presented all medical documents of my late wife Smt kamini devi, all complaints registered by me, against my son Manoj kurmi and his wife since 2006 in Behala Police Station, to Superintendent of Police, to Deputy Commissioner of police and to human rights commission in the year 2009.
On this date, I also come to know that my younger son Manoj kurmi and his wife has registered another FIR against me dated 01.01.2020, IPC 354A that on 31st December 2019, my elder son Naresh kurmi, grandson Amit Mahato, and I, we 3 tired to harm modesty of my daughter in law Chandni kurmi along with 20 other localites. These charges are completely false and base less, done against us to create more pressure on me. Same FIR dated 01.01.2020 states that my daughter Babita kurmi and Saroj mahato physically assault Manoj Kurmi, his wife Chandni kurmi and two children's. Therefore my daughters were booked under IPC 323, 344, 519 along with me, my grandson Amit Mahato, elder son Naresh kurmi.
Now police officers at Parnashree asked all 5 of us to take a bail against above charges. This is needless to say that as my younger son is a lawyer in high court, he has created some kind of pressure on Parnashree police station to get these two false FIR registered against me and my family.
On 7th January we surrendered in Alipore court, interim bail was granted against IPC 354A. When I came to submit surrender slip in police station at Parnashree later that evening, I see that date 7th January, police is registered a FIR in relation to complain made by my younger son Manoj kurmi on 25.12.2019 stating that I and other 7 members of my family murdered my wife under IPC 302/34 for property, jewellery and money.
For investigation, officer of local police station took all original medical records of my wife along with copy of complaints which I have made against my younger son and his wife all these years. No acknowledgement receipt was given to me after by police officer after I submitted all original documents for further investigation.
I have taken good care of my late wife Smt kamini devi with love and care. My elder son and two daughter's Saroj mahato and Babita kurmi has always stood beside me and my late wife when needed, without any hesitation or an intention to harm me or my wife for money, property and jewelleries. I have medical documents of my late wife since 1985 to 2019 to show my effort towards her deteriorating health condition all these years.
As my younger son is a lawyer in calcutta high court, he is threatening me, he is using his educational background to harass me, my other children's, and also my neighbours who have stood beside my family in this difficult time. On 3rd March, my younger son Manoj Kurmi, daughter in law Chandni kurmi, grandson Prateek and Aayushman kurmi started burning red chillis inside my house. I am suffering from respiratory problem since many years and I am dependent on inhalers. Purpose of such actions is to suffocate me, when my daughter babita kurmi tried to protest above mentioned 4 people abused her and threatened her of physical assault. My grandson Prateek and Aayushman kurmi, children's of Manoj and Chandni kurmi urinated in my room and threatened me of physical assault. Upon contacting parnashree police station, they failed to register a FIR against my younger son, his wife and children's. They noted a general dairy in their own words to report this incidence.
On 7th March 2020, my grandson Aayushman kurmi tried to stop me from entering my house by breaKing bottles made with glass inside my house. My neighbours saw this incident and reported this to parnashree police station where again 3 general dairy was registered against my younger son and his wife by our neigbhours at Parnashree police station. Moreover, a joint petition has been submitted on 11th March 2020 in Parnashree police station signed by 80 people to notify wrongful activities of my younger son and his wife on me and on my neighbours.
In these 5 months since my wife's death, my younger son and his wife has started selling valuable move able assets of my house, against which I have sent a letter complaining to parnashree police station, Commissioner of police and to Deputy Commissioner of South West kolkata through registered post on 25.02.2020. However I have not received any communication regarding my complaint.
I have been thrown out of my house along with my elder daughter who is dependent on me and my elder son Naresh kurmi. We have reported these incidence on 3rd March 2020 to local police station and on 7th March, but no action is taken against my younger son and his wife.
On numerous occasions my son and daughter in law has tried to threatened me of physical assault, suffocate me by burning dry red chillies in my house because I am suffering from asthma for over 10 years now, my grandson Prateek and Aayushman, s/o Manoj kurmi urinated in my house, his father my younger son spat on my face. My daughter babita kurmi was kicked by my daughter in law after reporting all these incidents officers at Parnashree police station has repeatedly failed to help me and my family.
My grandson Prateek and Aayushman is a juvenile, his father Manoj Kurmi and mother Chandni kurmi is misusing them to do wrongful activities upon me to escape from any criminal charges against them, these activities has been noticed by me and my neighbours.
My grandson Amit Mahato, s/o my married daughter Saroj Mahato has stood beside me in this difficult time with respect and faith. Today he is the only earning member of his family, working in an IT company is currently out of work since January 2020 due to these false cases against him. Since I am thrown out of my house, I am living with my married daughter Saroj Mahato, son in law Rabindra Mahato and grandson Amit Mahato. Today with great financial difficulty my grandson is taking care of his father Rabindra Mahato (a chronic heart and kidney patient), mother Saroj Mahato, my elder daughter Babita kurmi, elder son Naresh Kurmi and myself at his house.
I feel very ashamed of my younger son Manoj Kurmi and his wife Chandni kurmi. Whole purpose of all these activities is to capture my house. As mentioned I have a daughter who is dependent on me and a elder son, therefore I cannot disown them to fulfil greedy needs of Manoj and Chandni kurmi in my lifetime.
I have contacted district magistrate and sub divisional officer through registered post in first week of March to escalate my concern, and also contact Bar council of West bengal but still no action is taken against my younger son who is a lawyer and his wife.I am hopeful that you will understand me and my concern and help me to restore my right and dignity.
