Millions of Hindu devotees are very pained and shocked to learn that Tamil Nadu government is planning to melt temple gold and that too with lightning speed. It is completely illegal due to the following reasons:

1.     The offerings are made by Hindu devotees due to their love and faith.  The secular government does not have any role to decide which jewels should be melted.

2.     Honourable Madras High Court has clearly pointed out in the Suo Motu judgement dated 07.06.2021 that gold audit for temples have not been done for the last 60 years, there has been no inventorization and centralized registry of Jewels.  

3.     The court has directed that HR& CE to conduct an external audit by CAG under the expertise of ASI, created a central registry and update the Jewels details in the website for public.   Melting gold jewels before the external audit will invite contempt of court.

4.     Trustees are given the sole right to decide on this issue.  The HR & CE commissioner is just the approving authority.  It is a well settled position in law that approving authority cannot be the deciding authority and HR & CE does not have any right to decide which temple gold should be melted. 

5.     It is a known fact that Trustees are not appointed in temples for many years.  Functioning of temples without the trustee itself is illegal and deciding to melt the gold without the trustee is much bigger violation.  

6.     The action of the government in proceeding with gold-melting at an alarming speed without first carrying out an external audit and appointing Trustees are not only contrary to the provisions of the Act and Jewels Rules but also clearly mala fide, carried out with the deliberate intent to frustrate the orders of the Hon’ble Court.

We are  making a humble request to immediately issue an order to stop the jewel melting process.
