Why this petition matters

As per the proposed amendment in Income tax in the Finance Bill 2020 a new section 12A(1)(ac) will be introduced which will compel existing Charitable / Religious Institutions to Re-register themselves with the Income Tax Department w.e .f. 1.06.2020. It will also be mandatory to renew the registration and provide all justifications every five (5) years. The application for re obtaining the registration / approval will have to be given at least 6 months prior to the expiry of the registration / approval.
There are adequate checks & balances in the existing provisions of Income Tax Act & therefore there is no reason for introducing a new section for Re- Registration of existing charitable & religious institutions.
Such procedure of Re-registration every 5 years under section 12A(1)(ac) and the corresponding amendment in section 10(23) will either hamper or bring a halt to religious & charitable/philanthropic activities and will affect Schools , Hospitals, Universities, Educational Institutions , Temples , Dharamshalas, Orphanages etc. in the country instead of getting encouragement from the authorities.
All Charitable/Philanthropic & Religious Institutions must come under one roof and oppose this amendment as it is unnecessary & interfering in its' very nature.
