1. Employees who have opted for Pension and have completed 20 years of service only would be eligible for Pension benefits.ICICI Bank's stand in Court.
2. He is not employee of ICICI Bank ltd., he has resigned so we do not award him pension.
3. Since you have resigned, you are not eligible to get Pension. We have record with us that you had opted for pension while in service.
4. RBI, in its letter to our union, informs us that they have taken up the issue of Pension to employees of merged Bank with ICICI Bank and writes further that ICICI Bank has stated that they (ICICI) have ensured payment of Pension to all the Pension optee of the erstwhile Sangli Bank ltd on the ICICI Bank ltd as on the date of merger.
5. "To honour commitment made to the erstwhile Sangli bank employees it has continued the existing Pension Scheme for those who have become members of Pension trust by exercising their option with Sangli Bank in response to their circulars issued by Sangli Bank in the years 1994 and 2000." this is the written statement of ICICI Bank in HC.I was employee of Sangli bank ltd and had opted for pension in accordance with circular issued in 2000.
This is the stand of ICICI Bank ltd when dragged to court. But in actual, the ICICI Bank acts contrary to above statements of its own.
When they say in court that “Employees who have opted for Pension and have completed 20 years of service only would be eligible for Pension benefits”, then why they are not ready to award me Pension though I had opted for Pension while in service and had completed 27 years of service?
ICICI Bank says that I was not employee of ICICI Bank therefore I will not get Pension. It also says that since I have resigned I will not get Pension.
When even a dismissed or compulsorily retired employee can be given up to 2/3rd of pension, then why an employee who “resigns”,no one resigns casually, should be deprived of the same altogether without even been told before hand out about such a consequences of his/her giving letter of resignation or retirement.
Here, ICICI Bank is not only lying but it is also misleading and giving false statements in courts and hence it is misleading the Hon’ble Judges. I can prove on record that ICICI Bank not only paid Pension to resigned employees but also to those who were not employees of ICICI Bank ltd. There are some employees who had resigned 8/10 years before the merger of Sangli bank with ICICI Bank. Then, why this bias treatment to me and other employees who are demanding Pension they are eligible to get it.
As per the Amalgamation conditions, the management of ICICI Bank ltd is required to protect and give all the retirement benefits to the employees of the amalgamated Bank, for which they were entitled while in Sangli bank, who are resigned or retired prior to and after the Amalgamation. However it is noticed even after the period of, 11 and half years,the management of ICICI Bank is not giving proper response to the aged employees of Ex-Sangli bank ( they are all above more that 65 years now) and are adamant in nature.
Is it the treatment that the Sr.Citizen deserve from the MNC Bank like ICICI Bank ltd? Even they are not allowing peaceful protests and are trying to bring pressure on us through police authorities. Our PM says that the Sr.Citizens should be given respect and should be treated with Honour and what ICICI Bank is doing?
It is clear cut well established fact that ICICI bank ltd is intentionally and with prejudice mind is denying Pension to aged persons like us though we are fully eligible to get it. I give below some judgments of Hon’ble Supreme Court and Hon’ble High courts of the land. There are many judgments, in resignees case, but I am mentioning only few below where in the Hon’ble courts have directed the various Banks, including the Private banks,to release the Pension along with all the other dues. If the courts of the land, even Supreme Court, are giving judgments then why the Banks like ICICI Bank is denying our legitimate rights? Are they above the laws of the Land or they do not care laws of the Land and the government of the Land?

These are some of the judgments passed in favor of Resignee’s and banks were directed to release Pension with retro-respective effect. If the hon’ble Judges of Supreme Court,New Delhi,and HC Judges of Bombay,Gujarat,Bangalore and Madras( across the country) are of the same opinion then why ICICI Bank is adamant in its behavior?
IF ONE PARTICULAR JUDGMENT OF SUPREME COURT CAN BE APPLICABLE THROUGHOUT THE COUNTRY THEN WHY ABOVE JUDGEMENTS OF SUPREME COURT SHOULD”T BE APPLICABLE FOR MANY EX-EMPLOYEES LIKE US?
I am 65.Cardiac patient.No other source if Income.No one gives me any job.There are many who have reached 70.There were many who were dreaming of getting pension at least in their last days but died due to lack of medicines or good treatment in Hospitals. There is no doubt that we are financially and physically are not in a position, in any way to compete with ICICI Bank ltd and ICICI Bank knows it very well. THIS IS WHY ICICI BANK AUTHORITIES HAVE CHALLENGED US AND TOLD US, LET THE DECISION COME FROM SUPREME COURT. It knows that we have no capacity to go to SC.They have money to hire battery of many well known and famous lawyers of the land against us. But still we are fighting hoping that at least the Government and Law of the Land will come to our rescue. But when we do not know, may be after our death? At least our wives will get Widow/family pension.
Will, at least now, the ICICI Bank ltd. the Reserve bank of India, the Prime Minister,The Finance Minister, Labor Minister, Law Minister of GOI and Hon’ble chief justice of India look into this seriously?
