This is a petition for the Wallkill School District’s Committee on Special Education. The children of the Wallkill Central School District are not being provided a Free Appropriate Public Education (FAPE).
The Wallkill Central School District’s CSE is not considering the required continuum of services under Part 200 of the Commissioner’s Regulations for initial referrals, program reviews, annual reviews, or reevaluation reviews. Specifically the district does not offer or provide the following:
- Resource room for grades K-12
- Direct or Indirect consultant teacher program for grades K-12
- Combination of Resource Room and Consultant Teacher Model
Therefore, they are out of compliance and are in direct violation of CR Part 200. Thus, denying FAPE to every special education student in the district and those initial referral cases as well.
Additionally, parents requesting testing to determine if their child has a disability under Child Find regulations are also being denied.
It is imperative that a thorough review be conducted. We are aware that five areas were reviewed and investigated during the 2016/20017 school year. However, these items listed above were not considered during the review.
All of us, who are part of the Wallkill Central School District, look forward to your response and resolution to a practice that has gone on for many years to make the district accountable to all students; especially those with disabilities.
