I am the negotiator who worked this file. I have worked 150+ short sales with various lenders, large and small. Most lenders now realize that a short sale is a better option for them as well as the borrower and have come a long way in making the short sale process easier and more reasonable to obtain. Ocwen, an India based company and the 1st lienholder on this file, has been the most unreasonable, inefficient and difficult lender I have ever worked with. They have used every stall tactic and have made it obvious that they do not want to do a short sale, but would actually prefer to foreclose. If you read blogs and comments on the internet regarding Ocwen, you will find tons of people who have experienced the same problems with them that we have. This behavior is the "norm" for Ocwen. There is no logical reason why this short sale should not have closed months ago. The HOA would have been paid, the buyers would have a new home, Ocwen would have received more than a foreclosure will bring and our borrowers would be able to focus on their health issues and family. With a Foreclosure, everyone loses.

An all too common story in these strange times we are living in. The only way I know of to get this delayed and give some more time to work it out is through bankruptcy. Check with a bankruptcy attorney to see if this alternative might help if only to buy time.

I'm a Realtor and I see the banks create these red tape roadblocks all the time. They destroy the lives of individual families, either because they (the banks) are too incompetent, or to make an extra buck through some back door deal.
