On 01/02/2021, my brother Joseph Gabriel McGuire better known as “macho” was recklessly killed and left to die in a motor vehicle accident.

 He was getting a ride home to see his family and nieces. 

One of his closest friends at the time, Davian Sosa Kates was driving the vehicle, going 129 MPH at the time of the crash. He crashed into a royal palm tree and was the only person not injured. Immediately after crashing the car, he turned around and looked at his friends, who were severely injured and let them know that he had to go because he was going to go to jail. 

He then fled from the scene of the accident leaving my brother to die and other passengers in critical condition. He did not call 911, not even an anonymous call . It wasn’t until a law enforcement official saw the accident, that help came for the people left behind, including my brother who passed away in the hospital due to multiple blunt force trauma. Davian did not turn himself in until over a week later and has shown zero remorse for his actions. On the contrary, he has actually made comments on social media disrespecting our family and taunting us. 

Davian is now asking the court to consider the youthful offender act. A youthful offender would receive protection from specific adult sentencing (although they are over 18 years of age). If the court allows this, his MAXIMUM sentencing would be 6 years and could possibly be less. 

I am creating this petition to prevent the person who killed and left my brother to die from being declared a youthful offender. My family lost a son, brother, uncle, grandson, and so much more. Our lives have been changed forever. Our macho deserves justice and 6 years MAXIMUM does not sound like justice for my brother and for the other victims left in critical condition and life long trauma.
