Our justice system wrongfully convicted me. Lawyers hid evidence, including a confession from the accuser. This case is the result of the Wake County NC DSS Lying to The Boys Mother that the defendant had a prior conviction in Virginia just to get her to file the charges. Further, a trial witness for the state testified that I told his mother I had been convicted of this stuff. I did not have a criminal record. Read website www.falseconvictions.com . This was during a Motion for Appropriate Relief hearing. Do you think he was really effective? He was ruled that way because he was a former Wake County District Court judge and his friend ruled in his favor. Jeffrey confessed to me saying he was sorry and his own mother made him lie. The State of NC, filed a charge of Intimidation of a Witness to cover this up, and my own lawyer hid retrial dates so the audio tape would not surface. While I have done everyday of my sentence, however, I am still being punished. These convictions need to be overturned so I can have my life back. I am a good person that would never harm a child. You will see in my site a Victim Impact statement where the boys mother admits TWO weeks before trial that her son "FELT LIKE HE WAS IN THE WRONG". yet she made him go to court. Not to mention the pain I have had to go through because of this, it has drained my family financially. The attorneys stole 135,000 from us and worked for the state. All I tried to do was be a good person and volunteer my time to help needy families. I even met the boys father at a church bingo, and I told him about my charges. Not only did my lawyer hide evidence and court dates, he pled me guilty to the Intimidation charge without my consent. This is one of the most outrageous case I have ever seen. In 1992, Stephen Orringer was convicted for 2 counts of Indecent Liberties with a Minor and convicted about a year earlier on intimidation of a states witness charges in North Carolina but he was innocent and the charge of Intimidation was really to cover up the confession by the accuser. However, his lawyer, Mr. Phil Redwine, nor the Prosecutor assistant DA, Ms. Cynthia Baddour, brought out the childs confession at any trial. They knew about it and as his lawyer admitted during a Motion for Aprropriate Relief hearing. Mr Redwine, my lawyer , admitted on the stand about withholding the confession from the judge and jury. He said, "It would appear that the Defendant was trying to put something over on the jury." and decided not to use the tape at trial. Yet, Mr. Redwine was ruled as effective counsel. That does not sound like it was effective counsel to us. It appears and is clear to us that his lawyer was working with the prosecution to get him convicted. His lawyer. Mr. Phil Redwine, was a former Wake County, NC Judge in the same courthouse in which he was convicted.
There was evidence withheld at trial, including the recantation of one of the accusers statements that he had been molested. Further, during the motion for appropriate relief hearing, his attorney fabricated a story on the childs confession and witness to it. However, by reading this document, could you actually say his lawyer was really on my side? The defendant wanted the confession brought out at the Intimidation trial. His attorney said, "This trial is nothing, and we will bring it out by surprise at the "BIG" trial. His investigation has uncovered some pretty shocking evidence. His attorney believed that the tape was manufactured evidence and hid court dates on the intimidation so the truth would not come out. Therefore, violating his due process rights to a trial and appeal. Is that a job of an attorney to hide information from the judge and jury.
The prosecution had checked that the defendant could not be found. Failure to appear. How could he not be found when he had to call into a pretrial release officer and no one ever told him to appear. Further, the defendant was on house arrest nor was he notified by counsel to appear. The state should have known exactly where the defendant was. I do not know if my counsel knew my court dates or the prosecution just did not tell my lawyer. It was one of the two. His bond was revoked, warrant for his arrest was issued, and it was all corrected without him knowing anything about it. He would never have known this if had not of investigated his own case. This was their way of not letting me have my day in court and wanted to hide the truth so it would not come out during the appeals process.

His appealate attorney was Mr. Thomas Manning. I am not sure why the Defendant was not notified of his court dates and not notified until almost a year later on the appeals decision. The defendant was also allowed to remain on house arrest 11 more months after his appeal was decided. The only reason he can gather from all of this is so the new sex offender registration law would affect him. His motion for appropriate relief hearing was on Feb 16, 1994 and was decided on the same day. However, something strange was noted. The dates do not match on the court document. It appears that someone is doing some cover up work. Also, during my 2 years on house arrest, my intimidation of a witness case came on the calendar. I failed to appear in court because no one told me to be there and would never have found out if I did not investigate my own case. The Innocence Commission should hear this mans case to get at the truth. Isn't that what justice is all about.
Something needs to be done to make this situation right and justice needs to be served.
