OBJECTION TO THE DRAFT VALUATION ROLL 2017

As residents of Nyalenda we hereby raise an objection to the draft valuation roll 2017 seeking to apply new land rates on reteable owners of land properties in Kisumu County as follows:

1.    As published on 24th Dec 2020 in the Kenya gazette No 11063 Vol CXXII No 235 ,the draft valuation role and the proposed land rates lacks proper citizen’s participation as provided for in Kisumu county Public Participation Act 2015 and Article 184(1)(c) - participation by residents in the governance of urban areas and cities.

2.    The application of these rates negates the basic national values and principles of governance in article 10 of 2010 constitution and falls short of the constitutional threshold as far as public participation is concerned.

3.    The county government has not presented/tabled a clearly outlined plan to the affected land owners in respect of services such as water, sanitation, sewerage and other services for them to comply with these exorbitant land rates more so on freehold titles.

4.    The new land rate tariff will increase rates up to 7, 275 per cent on free hold land and 5,343 per cent on leasehold land in parts of Nyalenda as per the attached extract. These rates are exorbitant to the residents and this is material enough to consequently raise the cost of living in these settlements eg rent etc.

5.    In Nyalenda there are no commensurate services rendered by the county government to warrant such a draconian, punitive and unrealistic land rates

Sections 15 & 88 of the County Government Act 2012 gives any person the right to petition a county assembly and county government respectively to consider any matter within their authority, including enacting, amending or repealing any of its legislation that’s deemed detrimental to the welfare of all.

We therefore present this petition to the above named state officers to immediately put to a stop any application of the prescribed land rates until stakeholders are properly engaged

We also demand for immediate institution of a proper public engagement on this matter so as to arrive at an agreeable rates for the same.
