I hope you are well, where ever you might be reading this petition.

It is very sad it has come to a petition against the trustees of a Masjid, but we feel a sense of responsibility to keep our community informed about the illegal activities that are ongoing at their beloved Masjid Quba in Hayes. This has been carried out in secret by the very people the community had entrusted to run the affairs of the Masjid and safeguards its interests.

Some of you might already be aware of the ongoing issue in Quba Masjid, Hayes, between some of the trustees of the Masjid and the concerned Muslim community that built and uses the Masjid.

Please read the full article below to appreciate the gravity of the situation and the continuing apparent attempt to steal the Masjid from the community by the very people the community had trusted to manage and safeguard the Masjid.

Why do we need your signature?

+ To stop the transfer of the Assets of Quba Masjid (including the building and everything else the masjid owns) into a new organisation that has been registered in secret by some of the trustees.

+ To show the charity commission that the whole community are against the actions of the few trustees.

As you might already be aware the situation at Quba Masjid (Hayes), has been ongoing for years now as members of the Trustees of the Masjid have become fixated on excluding the community from the running of their own Masjid.

The situation has taken a turn for the worse once more and our fears have now been realised as these Trustees, through a legal firm, registered a CIO Foundation (no voting members) on 12/06/20 using the current name of Quba Masjid and Education Centre.

This means there are now two charities, with the same trustees, sharing the same name & address that are running in parallel. The CIO Foundation, Quba Masjid and Education Centre -1189923 is still a shell organisation.

Why register a shell organisation?

Creating this shell organisation paves the way for the next stage of the process towards changing the Masjid organisational structure into a CIO Foundation.

The next step is to transfer the assets (money, property, Masjid, staff, equipment etc) of the Quba Masjid and Education Centre -1122988 to the newly registered shell organisation (CIO Foundation Quba and Education Centre 1189923).

Confusing? Absolutely.

Done in secret? Totally.

YOUR MASJID IS AT RISK

What is the RISK? Some trustee members of the Masjid are blatantly and forcefully seeking to assume absolute power over the Masjid without any involvement from the community that had built and uses the Masjid.

 The intentions of these trustees for the Masjid is laid bare in the constitution of the newly registered shell organisation (CIO Foundation -1189923) which shows this new organisation will eventually be used to gain and solicit funds using the Masjid building as collateral.

Therefore, the assets of Quba Masjid are at a great risk.

If this wasn’t enough, another major risk is that we, as the Muslim community in Hayes, will lose any control of our Masjid as only the five self-appointed trustees will have full control over the whole organisation with no community involvement and with the intention to engage in risky business activities while disregarding the ideals on which the Masjid was built on.

The trustees of Quba Masjid and Education Centre have failed to provide the leadership role the community desperately needs and also failed to safeguard the Muslim community’s asset. They continue to engage in secrecy and are willing to do everything possible in order to transfer the assets of the Masjid.   

We can stop this from happening and retake our Masjid

Charity Commission states:

If you have permanent endowment (like Mosque property) which you want to transfer, you need to:

+ Register a new CIO, then
+ Make what is known as a vesting declaration. This is a legal document that transfers all the property of the original charity to the new CIO.

But the Charity Commission also states:

+ Consult the public about the proposed transfer
+ Ask the Commission to make a ‘scheme’, a formal legal document that approves the transfer.

In other words, registered members of Quba Masjid and Education Centre 1122988 must be consulted. Also, they need to consult the Masjid service users and donors.  

The CIO Foundation Constitution – Quba Masjid and Education Centre – 1189923

The constitution of the CIO Foundation was obtained through the Freedom of Information Act 2000 from the Charity Commission. It was constituted on 19/08/19 in which Quba Masjid had registered members whom were not consulted in regards to the formation of the CIO Foundation.

The constituted powers of the Trustees in the newly registered shell organisation -1189923 are absolute and nothing can be done if this transfer goes through.

In addition, the trustees of Quba Masjid and Education Centre (1122988) have appointed themselves to become the trustees of the newly formed shell CIO Foundation for 6 years from 12/06/20 – 1189923. Furthermore, according to the constitution they are eligible for re-appointment for a maximum term of 12 years.

TOGETHER WE CAN SAVE OUR MASJID 

THE COMMUNITY WANT THEIR MASJID TO REMAIN IN THE HANDS OF THE COMMUNITY

The issue with these very few trustees has now been going on since 2016 and so far three different mediation groups consisting of well-known and respected community Ulimaa (scholors) and elders have tried to reason with these trustees to no avail.

Finally, we need to stand up and protect our Masjid, for our kids and for the preservation of our Deen/religion. The Masjid belongs to no one individual but to the whole community.

+ The community through a fair membership programme should be consulted on which organisation structure we should adapt for the Masjid? CIO-Foundation which doesn’t permit members or a CIO-Association which permits membership and community involvement.

+ The community through a fair membership programme should have the power to depose and elect new trustees as necessary.

+ The community should be consulted on all major decisions that affect the Masjid and its community.

These few trustees are using every trick in the book to get their way and assume absolute power of this house of Allah by excluding the community. The trustees have even tried to finalise the transfer of Quba assets (including the building) during the Covid19 lockdown while the Masjid was closed. Above all, they are using the community’s donations to hire professional lawyers and enablers to transfer a community asset to a Foundation. If this happens the community will have no say in what happens to their Masjid.

This petition will play a role in stopping the transfer of the assets as this will be sent to the charity commission.

You have a duty to stop this transfer and save our Masjid
