I am POSTING THIS NOTICE let you know that HB 106 HD 2 has crossed over from the House to the Senate. It will go to the Seanate Energy Committee first, then to Senator Solomon who chairs the Senate Water& Land Committee, then on to Ways & Means. P.U.N.A. has spoken with a staffer from the Senate Energy Committee who has informed us that Rudderman (who is Vice Chair of Senate Energy will pass it out because he supports buffer zones being imposed in Puna & elsewhere. The language now in HB 106 HD 2 was inserted by Environmentalists working with Rudderman on the House side. It was a "gut & replace tactic".
 
We can stop this Bill now be sending emails directly to Senator Solomon requesting that she not hear HB 106 HD 2. If this can be done, we will not have to go through a hearing process and risk gavin the buffer zones reinserted into the measure in WAM or at a Conference Committee. Senator Solomon has said that if she hears from the people of Puna she will listen to their concerns.

Here is a copy of the letter I just emailed to her:

 "Senator Solomon,

I am a resident of Leilani Estates, Puna.  I am requesting that you not hear HB 106 HD 2. If you refuse to hear HB 106 HD 2, we will not have to go through a hearing process and risk having unnecessary buffer zones reinserted into the measure in WAM or at a Conference Committee.

You have said Senator Solomon that "if you hear from the people of Puna" you will listen to our concerns.

My concern is that my property will be made worthless for no scientific or other public safety issue.  A health study is being conducted currently by Dr. Peter Adler and as yet no health threat has been identified.  What is the need for an arbitrary buffer zone?  HB 106-HD 2 is clearly a legal and fiscal nightmare, ill conceived and with no scientific or other proof to substantiate such a consideration at this time.

Before condemning property owners, let research be done to confirm or deny any need for such a buffer zone and why the state, or county should exercise such eminent domain with no scientific data or substantiated empirical evidence for such a radical and financially devastating law.

I just signed the following petition addressed to: Residents of Leilani Estates, Nanawale, PUNA, Hawaii County Council.

We have successfully testified at the County Council of Hawaii to honor the Mayor's veto of Bill 256, Draft 2. The bill would allow the County to create a one-mile safety buffer zone around the Puna Geothermal Power Plant.

We must keep spreading the word, so that others that will find out about this story can get involved.

Below is part of our original Petition letter regarding Bill 256, Draft 2, and Bill 257, sponsored by Coucil Chairman Dominic Yagong, that 230 of you signed and helped to keep our community safe from unjust legislation for now...

"There is no study and systematic scientific evidence that substantiates a health threat to the residents near this plant.

Within the buffer zone, the County would offer to buy up properties at a max. 130% of the assessed value. According to the bill, properties would then have to be demolished and the property deemed uninhabitable.

Property values, the demise of our neighborhood, and future development will be at stake.

We who wish to stay and reside within and near the plant buffer zone will be financially ruined.

We support comprehensive health studies for persons residing near the plant and in the East Rift Zone, but feel an arbitrary buffer zone without scientific evidence will lead to a negative impact on the people, businesses, future commerce, as well as the unnecessary decimation of our beautiful section of East Hawaii.
