- We moved from Louisiana and brought our new swing set with us. We set it up right away, as not to kill our new sod.
- We received a violation for not having the swing set approved before putting it up. We didn’t realize a swing set needed approval, because it wasn’t clearly stated in the rules. We submitted our approval forms the next day.
- Within a week, we learned through an email that the ARB board has a height restriction on swing sets. This rule is not in writing.
- I wrote a letter to the ARB Board members asking for an exception to the height rule. The only part of the swing set that is not in their height restrictions is the tarp, which provides shade for my children.
- We received the formal disapproval letter 56 days after submitting our approval forms. I assumed we were approved because is 8.11 in the CCR’s it states, “Any requests shall be deemed approved if the ARB fails to issue a written approval or disapproval within thirty (30) days of the proper submission of all required documentation.”
- When I asked about this rule, I was told that they were waiting on me to resubmit a new approval form with the swing set within the required height restrictions.
- I was never told to resubmit a new application, as I was waiting to hear a response from my letter that requested an exception to the height rule.
How Our Swing Set Benefits Our Family:
- We homeschool our children and use the swing set many times a day for Physical Education and Recess.
- Two of our children have diagnosed disabilities and our current Speech and Language Pathologist has written a letter that we sent to the ARB that explains how the swing set improves their quality of life.
- Playing on the swing set has been a great way to meet new friends in the neighborhood.
- Swing sets improve physical, social, and mental health of our children.
How Can You Help?
- The conditions of denial stated, “The committee in its sole judgement, finds 13’ swing sets to have an unacceptable aesthetic impact to the Hammock Bay Community.”
- If the tarp doesn’t bother you, please consider signing our petition to keep our swing set as it is, so our children can have shade while playing. As a last resort, we would take the tarp down to keep the swing set, but that involves cutting the wood posts that connects to bigger pieces on the swing set.
