Remove Racist Deed Restrictions in Texas HOA/POA Bylaws

Texas allowed racist deed restrictions to be written into home and property owners association bylaws up until the federal Fair Housing Act of 1968 made the practice illegal.

Texas law has made it cost and resource prohibitive since then to remove the original racist language from historical bylaws for most H/POAs. Every time someone buys a home in these neighborhoods today they are confronted with the language that typically states (this is actual language in the Wagon Wheel POA, Wimberley Texas just outside Austin)

“The owners, their heirs and assigns, shall not sell or convey any part of said premises to a person not of the Caucasian race and no residents lot shall be used by persons not of the Caucasian race except as domestic servants working for the family occupying the residence.“

The inability to remove this language effectively, efficiently and completely continues to deepen the racist wound and cause harm to all of us who are confronted with it today.

Governor Abbott, we implore you to support legislation that allows H/POAs to expedite changes to bylaws with racist language allowing a clear, and cost effective, if not completely free process. This simple measure will further our ability to heal and shows care and compassion to all Texans.
