Common law marriage in Texas is a nightmare.  So many families are impacted by this law. In Texas there is no amount of time 2 people have to be together to be considered common law married. If you live under the same roof, sleep in the same bed, and have presented yourself as husband/wife you are common law married. Our dad was in the hospital after open heart surgery. He was not doing well and became in a veggie state. As a family we decided a dnr order would be best. After his oldest daughter completed paperwork his girlfriend came in stating she was his wife. Everything had to be placed on hold. The next day the girlfriend comes with a printed affidavit of common law marriage. The hospital states it was probably fake but they had to take it. The girlfriend then went against family and said she wanted to keep him on life support for atleast another 10 days.  His organs ended up shutting down on there own and nothing else could be done. He then passed. His body was later released to her. We asked he be taken back to Midland,TX to be buried by his mom or dad. She had him buried in Lubbock, Tx and did not allow his family to attend. She stated his 3 biological children and brother could go but that is it. She has not allowed his 14 year old to get any of her stuff or anything of his from his house. Someone our dad met in December of 2019 had the power over his own children, brother, and sisters.  Something has to be done. Change has to be made. No family should have to endure the pain we are experiencing because of this law. It happens more often than we know. Legislation has to change this.
