It is indeed shocking that despite two disability legislations in India- the Rights of Persons with Disabilities Act and the National Trust Act, there is a situation where families request death for their wards and this can largely be attributed to the failure of the state in providing facilities and services that been enshrined under the two Acts.

It also demonstrates a failure, particularly, of the National Trust that has been set up for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities and has as its mandate, through the Vikaas, Samarth and Gharaunda schemes:

a) To strengthen facilities to provide support to persons with disability to live within their own families;

b) To address problems of persons with disability who do not have family support;

c) To promote measures for the care and protection of persons with disability in the event of death of their parents or guardians;

d) To evolve procedure for the appointment of guardians and trustees for persons with disability requiring such protection;

e) To facilitate the realisation of equal opportunities, protection of rights and full participation of persons with disability.


And for all of these it is important to:

a) Make such facilities and services widely known; through the Press, local governments, NGOs and social media

b) Examine the need and potential for preventive education and counseling of

families, guardians, representatives of local services;

However the reality is that in 20 years of the existence on the National Trust, most people living with these disabilities and their families are unaware of these schemes and therefore unable to avail of their provisions. Hence while we urgently request your immediate intervention in this case, the situation also demands that the National Trust ensure immediate measures to ensure improved outreach, coverage, accountability and transparency of its schemes and services so that such incidents are not repeated.

Recently we came accross couple of two heart wrenching stories of an old parent requesting for the permission for euthunasia of his 23 old daughter with special need and another of a hapless mother killing her two sons who could not walk and then committing suicide!!

This, we believe is only the tip of the iceberg- these instances have come to light due to a proactive media. How many thousands of such children must be killed each year, as aging parents despair about their future in the absence of state support!

To begin with, this story which Merry Barua has drafted, highlighting these very issues, so I am raising this to PMO, MSJE, National Trust office as many people sitting in the concerned government offices to act as fast as possible and take necessary steps
