Sir, I am an Indian Chakma, from childhood my parents didn't make me realize that we are treated as refugees in India, they always advice and taught me to respect our Nation, our National Flag, National Anthem which comes first before my parents. I feel proud whenever i go to school and sing National Anthem of India, i feel proud whenever i host and salute our National Flag. But gradually when i grows up the newspapers, Tv channels, Internet and others Citizens residing in India told me that I am a refugee Child, which makes me very sad.
On 1.9.1996, a historical Judgement passed by the Hon'ble Supreme Court of India directed the government of india and the state government for granting citizenship to the Chakmas and Hajongs came in India between 1964-1971, but both the Central and State govt. didnot comply and failed to keep the commitment granted by the Constitution of India . In the said case the Hon'ble Supreme Court directed the Government of India and Govt. of Arunachal Pradesh for the conferment of Citizenship rights u/s 5 of the Citizenship Act, 1955 and also directed to give equal status, life and liberty just like other citizens of India. But the Government of India and Govt. of Arunachal Pradesh didn't confer the judgement as directed by the Hon'ble Supreme Court of India. Similarly the Supreme Court of India passed an order in 2015, for the conferment of citizenship to the Chakma and Hajong of Arunachal Pradesh within three months. With long pending finally "the Government of India giving citizenship to the Chakmas and Hajong came between 1964-1971, but without other rights as granteed by the constitution of India" (sources like TV, Newspaper, internet etc).
it is to note that Maximum of Chakma and Hajong residing in Arunachal Pradesh are born in India, so we are ipsofacto citizen of India by birth, u/s 3 of the Citizenship Act, 1955. We the Chakma and Hajong born in India deserves all the rights just like others Citizens of India. We were humiliated by the Government of Arunachal Pradesh, Student Organization and other NGOs, which was marked and noticed by the Hon'ble Supreme Court of India in NHRC vs State of Arunachal Pradesh.
The the Government of India has done historical Injustice to the Chakmas and Hajongs during the time of pertition, since then we were victims of Injustice. Our forefathers came here in India to live peacefully as like other cizens of India. Chakmas considered themselves citizen of India, they too host National Flag of India before the Independence and partition and also they can die for Motherland India. But we were even denied basic rights as gauranteed by the constitution of India. No job, no basic facilities, etc but still we belived in Secularism, Democracy and waiting for Justice. We love motherland India, we love people of india.
In the recent Meeting the Central and State Govt. decided to grant Citizenship to the Chakmas and Hajongs of Arunachal Pradesh but without having any other rights. Chakmas and Hajongs tribals residing since before the creation of Arunachal Pradesh so the decisions of denying any others rights is completely unacceptable, discriminatory, violation of Article 14 and 21, violation of Human Rights, ultra vires and uncostitutional. We should have all the legal and Constitutional rights including Citizenship rights, land rights, Employment rights, ST status etc.
Lastly my submission to the Central and State Govt. and others concerned authority of India are:
1. To treat us as Indian just like other. Citizens.
2. Grant citizenship to our forefathers as directed by the Hon'ble Supreme Court.
3. Provide us all the rights as mandate and guranteed by the Constitution of India.
4. Save us for being stateless people.
5. Provide justice as per law
6. Don't make any discriminatory decision.
