          Many people in America have faced an invasion of their privacy. As we’ve seen the odor of marijuana being ruled inadequate to justify search and seizure in other states, it is time for our state to adapt to these changes as well. The surplus of marijuana arrests we’ve already seen in years past has proved more harmful and costly than beneficial. The odor alone of marijuana is simply misleading as the smell lingers for days. WIth the mass amount of spending dedicated to court processing and inmate housing, a change like this would save taxpayers high dollars to limit the focus on non-violent low offenses. 


         As the war on drugs was ultimately started with foul intentions and has evil within its roots, this change would push our society in the right direction of change. Furthermore allowing us to put more focus in developing our youth and help prevent more violent crimes. While other states have already made this change, ours is behind and why wait for other states to take charge when we can be among the first to make this adaptation. 


            In the case of Michael Pacheco v. State of Maryland, the court overturned the seizure of Mr. Pacheco’s contraband; Stating “in the post decriminalization era” the smell alone of marijuana does not grant officers probable cause to conduct a search incident.
