Do not sign S 240.33 The Annoyance of a police officer bill.
Gives the "peace" officer an additional potential unabated, arbitrary ability to abuse power.
- Governor of New York State
Governor Andrew Cuomo
Dear Governor Cuomo,
We are asking you not to sign the bill S 240.33. This bill gives the "peace" officer an additional potential unabated, arbitrary ability to abuse power.
Blogger Carlos Miller wrote, "As many of us have learned,[ Particularly in the Minority communities], it doesn’t take much to annoy a cop. Taking photos of cops can get you beat up, handcuffed and arrested. And verbally protesting that arrest can get you charged with resisting arrest." The petition writer had a personal experience with an officer, who they "annoyed", because they didn't move fast enough, when they had stopped to observe the police's interaction with a few members of the community. Therefore, they were given a summons for disorderly conduct. The court dismissed it. According to this bill, they merited jail time because they had annoyed the officer!
There are adequate laws already in place to protect police officers if they are truly assaulted:
NY penal code
120.08 Assault on PO--Class C felony
C Violent Felony: 3 1/2 to 15 years
C Non Violent Felony: No Jail, Probation, 1-2 years to 15 years
120.11 Aggravated assault on PO--Class B felony
B Violent Felony: 5-25 years
B Non Violent Felony: 1-3, Max 25 years
120.18 Menacing a PO--Class D felony
D Violent Felony: 2-7 years
D Non Violent Felony: No Jail, Probation, 1-3 to 7 years
The minority community is already subjected to an extreme amount of " Stop and Frisks ". If the S 240.33, ' The Annoyance of a police officer bill ' is signed into law, in addition to "Stop and Frisk", the minority communities will be living in not only a police state, but an apartheid state too. As we know, this new bill will be unequally, applied primarily to the Minority communities, as the "Stop and Frisks" are.
We are the canaries. Fascism is on it's way..for EVERYBODY!
Governor Cuomo have some foresight, and please use your common sense. Don't sign S 240.33.
