On 5th July 2015, three men who assaulted and raped Kemal, a trans sex worker activist in Turkey, were released by the authorities. The men continued to threaten Kemal with death and attacks on Kemal’s cell phone. Legal steps helped to stop the threats, yet the court unlawfully rejected a request to extend the protection order. While the appeal awaits the ruling of the higher court, Kemal currently remains unprotected by the State and vulnerable to any potential threat or act of violence.

The three assailants had their first court hearing on 27th October 2015. Kemal’s lawyers demanded that 3 accused men be charged with sexual assault, malicious injury, theft, insult and constraining personal freedom through violence. Unfortunately the Ankara court refused to arrest the perpetrators, and released them pending their trial scheduled for 26 January 2016.

Given that Kemal has been receiving threats and trans phobic insults from the 3 men who broke into their home, assaulted and raped them, and stole their property, the decision to release them is not only unjust but also dangerous.

For the upcoming trial on the 26th of January, we call on the government of Turkey to provide Kemal with safety and security, and take all necessary measures for an impartial and effective investigation to take place.
