  • We are the home buyers of Hilife Greens (RERA project registration number PRM/KA/RERA/1251/446/PR/180504/001598), an under-construction project in Balagere,Gunjur area of Bengaluru, Karnataka, undertaken by Hilife Ventures Private Limited (CIN U45200KA2013PTC072778).
  • As per BBMP approved plan it has 342 units distributed across 6 towers namely A, B, C, D, E and F.
    A, B, and C has 10 floors in each tower, whereas D,E and F towers have 9 floors. Each floor in each tower has 6 units.
  • The project commenced around 2018 and the committed date for delivery of the project to the home buyers (as per Sale and Construction Agreement) was Dec 2020
  • The project since the beginning has been running into several conflicts which we have listed below. While some of them were bearable, recent ones in the last one and half years landed many buyers in conflict of interests:
    • In Feb 2019, many buyers who had already booked the flat by signing agreement came to learn that the carpet area being provided for their flats is considerably smaller (by 10-15%) against what was mentioned and committed in the Sale Agreement. On raising this issue, the builder threatened that if the buyers dare go to court; it will result in delay in possession and that nothing can be done now. It is a mistake and should be let gone. On the other hand, if buyers co-operate with the builder; they could get the possession of their flats around August 2020, which is 4 months earlier. The builder however did not give this in writing to the impacted buyers.
    • Starting from Nov 2019, the project work had stalled. The builder mentions lack of fund to carry the project forward. This state of halted work continues to the date.
    • In June 2020, the homebuyers are shattered by another unraveling. It comes to knowledge that the builder has re-sold around 50 flats which were already sold to home buyers; to another third parties. The builder now justifies this by saying it was done to cover funds shortage. The agreement however contradicts the fact that the EC entry for these dual conflicting agreements with third parties were signed in Feb 2019, which is long before. Also, the fact that the builder chose to re-sell the already sold units instead of selling available non sold units speaks a lot about intentions and ethics of the builder. Till today as per our knowledge, the dual agreements have not be cancelled and the issue stands still.
    • During all this, we the home buyers also learned that the builder has sold new units (discovered via EC entries for sale agreements for10th Floor units in D, E and F towers) which were deviations from the approved BBMP plan. This shall impact UDS and many other issues. The home buyers were not informed about this. The builder till date keeps assuring that they will not construct 10th floor in D, E and F towers until they get all the needed approvals. They also neither deny nor confirm the existence of EC entries for these new floors in D, E and F block.
    • Furthermore to the agonies and anxiety of the home buyers; the builders announces plan to bring in another third party to which they shall delegate the construction work. Nothing more is shared around this. The homebuyers did their own investigation only to discover that allegedly, the third party intends to construct row houses at the places of common amenities in order to cover the profits. This may add further losses in terms of UDS and amenities. Amidst lockdown time; we the homebuyers, tried to escalate this with the Govt of Karnataka, Commissioner of Police Bengaluru, RERA Karnataka via email.
  • What we have done so far to protect our hard earned investment for our dream home:
    • We had sent legal notice in Nov 2020, to Hilife Ventures Private Limited and all the other stakeholders to either cancel the dual agreement conflicting our claim to the title and deliver the project on scheduled time; or refund our hard earned money back. The builder did not respond to our notice.
    • We made several visits to Varthur Police station during March 2021 to raise the illegality of the matter and seek counsel and relief. Nothing fruitful came out of the visits, as the builder did not co-operate with the Police officials.
    • We have had several meetings with the builder to resolve the matter and give another chance to builder to fix the mistakes.
    • We have filed grievances to RERA via RERA web portal. Some of the homebuyers have had our first hearing with RERA in June 17th 2021, where the builder didn't appear in the online hearing.
  • What are we seeking via this petition:
    • Kindly step in and help us secure our home. The project is already delayed by many months and even after resume, the completion will take many more months further ahead.
    • Kindly take authority and supervision of the project so that Hilife Ventures Private Ltd may work in transparency and do not add further complications with their illegal tactics like bringing in third party to construct row houses or sell another set of already sold units to a any third party in the future.
    • Kindly restrict Hilife Ventures Pvt limited to do any transactions inside or outside Hilife Greens project; before they resolve the open conflicts and ensure that the investments of the homebuyers are secured. 
    • If the builder doesn't have good intentions, please help us reclaim our money back. We are already suffering much by not getting our flats in time, paying home loan interests alongside house rent. Mental agony we are going through is immeasurable.
