Why this petition matters
Ever since the nirbhaya case in 2012, cases of rape and murder have been becoming increasingly more common. The victim of rape if not murdered brutally on the spot lives in fear of her rapists, the family and friends wage a continuous war to gain Justice, which more often than not, is insufficiently provided. The dignity and life of a woman is destroyed completely because the society is close-minded to such people and they end up feeling isolated and degraded. All this while the rapists roam free or, if caught and thrown in jail, live and eat well in jail. Even if they maybe sentenced to death, they are never given a final date and hence Justice is not served properly. Sometimes, they are provided with bail and mercy pleas are accepted which is also an obstruction to Justice.
As a concerned citizen of India, a son, a brother and a friend, the way rapists are treated is a manner of disgrace to us Indians. We pray to many goddesses and hold women in high regard but is that all on paper? Not allowing women to work past 8:30 pm is not a solution just because a lot of the rape cases occur in the dark of the night. Would we stop our women from leaving their rooms if rape started becoming more common in the daylight hours? Is this truly a solution?
What we need at the moment is a separate court for cases of rape, especially the more gruesome ones, which is the first and final court the accused will be presented before and whose sentence can not be challenged by any individual in another court. The guilty shall not be given the privileges of bail, parole, mercy pleas or any other provision which shall serve as a loophole for them to step out of the prison for even a moment after being sentenced. In case of death sentences, a final date of carrying out the sentence shall also be issued. For cases of rape and murder, especially more gruesome ones, the accused shall not be given death sentence instead they should be killed in a similar manner as their victims. In case of a minor being a part of the accused party, especially if he is 16 or 17 years old, he should be treated as an adult for the heinous act committed should not be judged based on age. The use of the "The victim was wearing indecent clothes" should also be banned as no one should decide what a women can and cannot wear.
