Change the legislation around section 59 - make it evidence based
We need to stop the police giving out Section 59’s without reason in situations of no clear evidence. The section 59 is inherently vague in its wording which gives license for police officers to abuse their powers and hand these out without any evidence. Drivers are not given any rights during this interaction to prove their innocence or contest a section 59 which also means that officers can get away without having to provide any context to section 59’s that they give out. This smears everything that our justice system stands for which is innocence until proven guilty when these can simply be given out for any reason and even without evidence. It is important to the remember that the police work to protect the public and should work without a set of guidelines that are clear and precise so that everyone understands the rules in which we live. With growing mistrust and injustices the police force are achieving, change has to happen. They will respond with the fact they’re doing their jobs and/or if you are driving in a lawful manner then you should be fine; however when abusing this power and unfairly issuing such charges to innocent driver’s, massive injustices occur. We need change. We need to protect the hard working, innocent younger driver’s. We need to stop the police abusing their power with such a vague charges. With mental health becoming increasingly more common - extended paranoia and anxiety will be caused by constantly fearing the ability to drive a vehicle and checking in the rear view mirror if you’re being followed by a force that is meant to protect you. Nothing such as a protective force created for the people should be a tool to create fear. I have been put in this position by Merton traffic police and am extremely confused, angry and upset but the abuse of power served by two officers acting cagey and unresponsive when questioned. Giving no answers with no evidence, lying and saying different things to people involved and one switching off their body cam because they knew they had no grounds. We need a reformation, we need clarity of details involved as such what led to and why it led to a charge given. We need protection and trust that we the people entrust in the police. We need the police to stop abusing their power and abusing vague parts of the traffic law. Please help spread the awareness and help stop injustices given to young innocent driver’s trying to live and enjoy time with their friends.
