Today, The monumental and historical dias where the current Constitution was promulgated was the first casualty of the private capital! Uhuru Park is being auctioned to private capital. It's all brick and mortar! No value for green spaces. That's Uhuru's model of development.
Uhuru Park is a 12.9ha green open space and recreational Park adjacent to the Nairobi Central Business District and was opened to the general public on the 23rd of May 1969 by President Mzee Jomo Kenyatta. It contains an artificial lake, several national monuments, and an assembly ground that offers its users a social, political, and economic space. Uhuru Park is monumental and historical to many Kenyans as a symbol of the struggle for Kenya's freedoms.
Uhuru Park is one of the five parks within Nairobi City alongside Central Park, Michuki Park, Jevanjee, and Uhuru Gardens. Trees at the Park have previously been cut down to allow for the 'development' of the city, jeopardizing the migratory and exotic birds that find their home in the Park; the same will consequently affect the rate of pollution in the city.
On the 29TH of September, 2021, Uhuru Park was closed from the public after a motion was moved by the Majority leader of the County Assembly, Abdi Hassan, to renovate the Park. Nairobi County closed down the Park on a false pretext for renovations without involving the public in making such a decision. The same was made with no regard to the traders or users of the Park, violating;
Article 174 of the Constitution of Kenya provides that the devolved government should give people the powers of self-governance and enhance the participation of the people in the exercise of the powers of the state and in making decisions affecting them.
Article 196 (1) (2) mandates the Nairobi Metropolitan Services (NMS) to facilitate public participation in the legislative and other business of the assembly and its committees. Additionally, the traders in the Park had paid for their trading licenses and no alternative, grossly affecting the pursuit of their social and economic rights under Article 43 of the Constitution.
NMS failed in his statutory mandate to engage, inform and notify the public on the proposed development and renovation of the Historical Park.
