Terminate General Land Office Lease No. SL20140032
Lydia Ann Channel Moorings, LLC is operating a barge fleeting facility without a US Army Corps of Engineers permit. Therefore Lydia Ann Channel Moorings, LLC is in default of its Texas General Land Office "GLO" Lease. The GLO has failed to terminate the lease which has been in default for over a year and as a result of that failure and hurricane Harvey, two tug boats were grounded, one tug boat sank, and six barges now rest as an eye sore in the middle of San Jose Island for the foreseeable future. The submerged land leased from the GLO is located within Texas Parks & Wildlife Department's 32,000 acre Redfish Bay State Scientific Area, which was established in the year 2000 to protect valuable and sensitive sea grass beds.
Please contact George P. Bush, Commissioner of the General Land Office, and encourage him to end this travesty and terminate the defaulted lease.
On September 14, 2014 the General Land Office of Texas "GLO" under then Commissioner Jerry Patterson, issued a lease to Lydia Ann Channel Moorings, LLC "LAM" for 1.5 miles of submerged ground along west shoreline of San Jose Island in Lydia Ann Channel. The terms of the lease required that LAM abide by the terms of a Letter of Permission permit from the US Army Corps of Engineers "USACE". When the USACE ruled that LAM had violated the terms of the Letter of Permission, they revoked the Letter and required LAM to remove their facility. This caused LAM to be in default of the GLO lease and the GLO sent LAM a default letter on September 12, 2016. LAM continues to operate without permission and under a lease that remains in default.
