Hello I'm Maria Behill and I have a story to tell you about my handsome, wonderful  hero older brother name David A. Esparza SR. That isn't home with his family because he was taken away from us by a system that pretends to protect us. My Brother David has been INCARCERATED for about 20 years for "DEFENDING OUR FAMILY." 

Our family and I truly feel his IMPRISONMENT and his LIFE sentence for a gun enhancement is UNJUST. On March 12,2001 my brother was accused of shooting John Perkins because he was at my Aunts residence harassing and threating her & everyone else who lived there, over $30.00 phone bill my aunt step-son owed, Mr.Perkins girlfriend mother.

Mr.Perkins showed up to my aunts house and argued with my aunt stepson about the money, he said he will be back in 10mins for him to have the money. When John Perkins came back to my aunts home he wasn't alone he came back with a few more men and a woman, Mr.Perkins and the woman entered a closed gate onto the property, with no ones permission. Mr.Perkins tried stealing her love birds she had outside hanging on the tree, my aunt Debbie came out to confront Mr.Perkins about him being in the yard and to put her birds back, thats when he started to threaten her and her children who were home at the time. My cousins came out because they heard screaming. Before Mr.Perkins and his friends left someone threw a camera at her mind you she was 8 months PREGNANT at the time, Mr.Perkins  threaten my aunt saying "I WILL BE BACK."

My Aunt Debbie was so afraid for herself and everyone living in the home, so she ended up calling my brother David who was down the street and when he finally arrived seeing her crying and shaken up he did what he could do just comfort her and the kids. While doing so, Mr.Perkins and 8 others of his white friends surrounded my Aunts home. David has always been a protector he's the oldest out of 5 siblings we grew up rough with an alcoholic and drug addicted mother in and out of prison system no father figures in our lives, so my aunt Debbie at the time took care of  I and my 2 little sisters along with her 3girls. As they were about to enter the property David came outside and shot at them in trying to just scare them away but not knowing at the time Mr.Perkins was (GRAZED) by a bullet. David not knowing what was Mr.Perkins intentions were or if he or someone else had weapons, since he's been threating and coming back and forth 3xs into the property.

When David was arrested and how we were raised and how we grew up not trusting Law Enforcement he just kept his mouth shut in doing so, didn't realize how the system was going to railroad him. The truth was never said just Mr.Perkins side in his own words he stated he came to my aunts harassing her and attempted to burglarized.  Nothing happened to him though he was the cause and was at fault for everything.  Since David has been incarcerated he's been on a straight narrow road he's driven he's focused he wants to come home.

  He's exhausted every way possible from appeals to Franklin law to commutation, just everything he can possibly think of, he's gotten some achievements and certificates from programs in there, as a family we visit we send packages we put money on books he calls us we do our part as a loving/caring family. David knows the mistake he's done and he has grown so much he is married with a family of 7 kids and 2 grandbabies, he's an uncle to 7 nephews and 1 niece, he goes to the parole board in 2025 but thats not ever promising he wants too come home soon or just get a DATE.

I know for a fact he would do things much differently his mind is healthy and focused I just hope he gets a chance or if someone can steer me in the right path to help him WE AS A FAMILY WOULD APPRECIATE any advise or guidance to help us bring him home. I TRULY APPRECIATE ANYONE WHO READS THIS.
