     Canadian Utilities Limited, ATCO, and Quanta Services inc. founded the consortium Luma Energy, which is a Canadian-American company that was established on January 17, 2020, under the direction of President Wayne Stensby, to serve Puerto Rico. Since the company arrived on the island, subscribers -which are the entire island since the Puerto Rican Government signed a contract directly with Luma, making electricity public-private and creating a monopoly between the AEE (Agency of Electricity Energy) and Luma Energy- have been suffering outages, and their electricity bill keeps on increasing even though the system is poor.

     After Hurricane Fiona hit the island at category 1 on September 18, 2022, the whole island lost power, even though the Hurricane only passed through the southwest. The company stated that they were going to bring 91% of the power to the island but they failed to honor their promise. When the president of the United States came to the island he was informed that 99% of the island had electricity, which was far from the truth. Luma shut down a website they had where people could live-track the places with energy and without it. Majors from multiple towns took action and hired private companies to reestablish power in their towns, Isabella, Villalba, Aguadilla, Naguabo, and many other towns reestablishes their energy, and cleared and clean the lines on their own. This was something that made Luma Energy mad, and they threatened the majors with filing a complaint in court because they were “Risking the lives of the brigades, ruining their plan, and not matching their work standards.” Meanwhile in the public hearing carried out on October 5 2022, in the House of Representatives in Puerto Rico, Wayne Stensby stated that “all the arrangements were temporary,” doing the same they criticized the linemen contracted by the major did: “ a Patch.” Following the Municipal code of Puerto Rico, majors can" carry out all procedures and tasks necessary to normalize or restore the electrical energy system (Acevedo, 2022)." On another note, Luma Energy was hired because there was “NO” company on the island, nevertheless, according to my investigation, there are 15 private companies (both, solar and electricity, besides AEE) on the island, and some of them are the ones currently being contracted by the majors like “Villalba Power,” along with many former employees of the AEE. 

    This petition is very important for the livelihood of Puerto Ricans, since many of those affected by constant power outages are hospitals, and people that live on life support and required medicines that need to be refrigerated (insulin), or machinery to breathe (sleep apnea, asthmatic, oxygen tanks, etc.), and dialysis. Without electricity, schools are not operating properly and since Hurricane Maria, people are still been affected by constant power outages that sometimes last hours or even days, and with the arrival of Luma Energy, it was promised the system would be re-established and fixed. Due to the constant outages, subscribers had lost electrical appliances (freezers, TVs, washing machines, etc.) and they are constantly forced to throw away their food and having to buy new groceries -food prices in Puerto Rico are higher than in the United States due to the Jones Act, which forbade Puerto Rico from freely commercializing and forced them to only use American transportation for their goods. With the previous company, AEE outages were not a common day-to-day incident, and the electricity bill was never as high as it is currently, since Luma's arrival there have been seven increments to the bill. “The lack of electricity has already killed several Puerto Ricans in the aftermath of Hurricane Fiona. At least five of the 21 hurricane-related deaths are attributed to deadly accidents with generators or to candles being used to light up dark homes (Acevedo, 2022).”

    It is imperative that the contract get canceled since in November they would receive an extension to their contract for 15 years. In october 11, 2022, the Fiscal Control Board ( which is controlled by the United States Congress, and Puerto Rican haves no say because they are second class citizens)  are determining to increase by 23 dollars a month subscribers' bills for 50 years to pay for a debt, they will be paying on top of their regular bill that sometimes surpasses $200, and the minimum wage on the island is 8.50. Said contract states that if the company were to be sued, the people (referring to the inhabitants of the island) would be the ones that would pay for any fine imposed to either Luma or the AEE.

   Canadian Utilities Limited, ATCO y Quanta Services inc. fundaron el consorcio Luma Energy, que es una empresa canadiense-estadounidense que se estableció el 17 de enero de 2020, bajo la dirección del presidente Wayne Stensby, para servir a Puerto Rico. Desde que la empresa llegó a la isla, los abonados -que son toda la isla, ya que el Gobierno de Puerto Rico firmó un contrato directamente con Luma, convirtiendo la electricidad en algo público-privado y creando un monopolio entre la AEE (Agencia de Energía Eléctrica) y Luma Energy- han estado sufriendo apagones, y su factura de electricidad sigue aumentando a pesar de que el sistema es deficiente.

   Después de que el huracán Fiona golpeara la isla con categoría 1 el 18 de septiembre de 2022, toda la isla se quedó a oscuras, a pesar de que el huracán solo pasó por el suroeste. La compañía declaró que iba a llevar el 91% de la energía a la isla, pero no cumplió su promesa. Cuando el presidente de los Estados Unidos visito la isla se le informó que el 99% de la isla tenía electricidad, cosa estaba muy lejos de la verdad. Luma cerró un sitio web que tenían donde la gente podía hacer un seguimiento de los lugares con energía y sin ella. Alcaldes de múltiples pueblos tomaron acción y contrataron compañías privadas para restablecer la energía en sus pueblos: Isabella, Villalba, Aguadilla, Naguabo, y muchos otros pueblos restablecieron su energía y despejaron y podaron las líneas por su cuenta. Esto fue algo que enfureció a Luma Energy, quienes amenazaron a los alcaldes con radicar una querella en tribunales porque estaban "Arriesgando la vida de las brigadas, arruinando su plan y no cumpliendo con sus estándares de trabajo." Mientras tanto, en la vista pública en la Cámara de Representantes efectuada en septiembre 5 2022, Wayne Stansby mencionó que todos los arreglos que hicieron era “provisionales” haciendo él lo mismo que criticaba de los celadores contratados por los alcaldes: “un parcho.”  Siguiendo el código municipal de Puerto Rico, los alcaldes pueden" realizar todos los procedimientos y tareas necesarias para normalizar o restaurar el sistema de energía eléctrica (Acevedo, 2022)." Por otro lado, se contrató a Luma Energy porque no había "NINGUNA" empresa en la isla; sin embargo según mi investigación hay 15 empresas privadas (tanto solares como eléctricas, además de la AEE) en la isla, y algunas de ellas son las que actualmente están contratadas por los alcaldes como “Villalba Power,” junto con muchos ex empleados de la AEE. 

   Esta petición es muy importante para la subsistencia de los puertorriqueños, ya que muchos de los afectados por los constantes apagones son los hospitales, y las personas que viven con soporte vital y requieren medicamentos que necesitan refrigeración (insulina), o maquinaria para respirar (apnea del sueño, asmáticos, tanques de oxígeno, etc.), y diálisis. Sin electricidad, las escuelas no están operando adecuadamente y desde el huracán María, la gente sigue siendo afectada por constantes apagones que a veces duran horas o incluso días, y con la llegada de Luma Energy, se prometió que el sistema sería restablecido y arreglado. Debido a los constantes apagones, los abonados han perdido sus enseres eléctricos (neveras, televisores, lavadoras, etc.) y constantemente se ven obligados a botar su comida y tener que comprar nueva - los precios de la comida en Puerto Rico son más elevados que en Estados Unidos debido al John Act, que impide la libre comercialización y obliga a Puerto Rico a usar transportes Estadounidenses. Con la empresa anterior, los apagones no eran un incidente cotidiano, y la factura de la luz nunca fue tan alta como lo es actualmente, puesto que Luma desde su llegada han hecho siete aumentos a la tarifa. "La falta de electricidad ya ha matado a varios puertorriqueños tras el paso del huracán Fiona. Al menos cinco de las 21 muertes relacionadas con el huracán se atribuyen a accidentes mortales con generadores o al uso de velas para iluminar hogares a oscuras (Acevedo, 2022)."

   Es imperativo que se cancele el contrato, ya que en noviembre recibirían una extensión de su contrato por 15 años. A partir del 11 de octubre de 2022, la Junta de Control Fiscal (la cual está controlada por el Congreso de los Estados Unidos, y los puertorriqueños no tienen representación porque son ciudadanos de segunda clase) está determinando aumentar en 23 dólares mensuales las facturas de los abonados por 50 años para pagar una deuda, que estarán pagando además de su factura regular que a veces supera los 200 dólares; el salario mínimo en la isla es de 8.50. También, dicho contracto específica que si la compañía fuera demandada, sería el pueblo (los habitantes de la isla) quienes pagarían la multa impuesta a Luma o a la AEE.
