On a regular basis, the Fremont Unified District Teachers Association (FUDTA) and the Fremont Unified School District (FUSD) negotiate employee compensation. The last negotiation was concluded on July, 2018. They are negotiating again.

As of 12/03/18, FUDTA has declared impasse. The next step is mediation involving an independent, third-party mediator. On 01/07/19, right after Winter Break, FUDTA has initiated and continues a condition known as “work-to-rule” with all Fremont public schools.

Work-to-rule means that FUDTA is instructing teachers to work 6 hours per work day – teaching 5 classes with 1 hour of preparation time. This is the “rule” as described by the current FUDTA employment contract. Teachers are expected, by FUDTA, to stop spending any time beyond these 6 hours doing their work educating our children.

Work-to-rule can impact different schools differently. At the elementary level, one of the most painful consequences is the cancellation of Science Camps. At least one elementary school has already announced cancellation. Other elementary schools are heading toward the same cancellation direction even though some schools are holding back official announcements. The students look forward to the Science Camps. It is a major highlight and a fond memory of their early education.

With Jr. High and High Schools, all before and after-school events, activities, clubs and programs needing teacher support face cancellation. Furthermore, high school students needing recommendation letters for college or university admission would not be able to obtain them from teachers following work-to-rule.

For all Fremont public schools at all levels, there are now questions and problems with homework assignments and tests. 6 hours per work day are not sufficient to handle these needs. Homework assignments and tests had been skipped and/or canceled the last time work-to-rule was implemented. That was June, 2018. These problems are again occurring this time.

It is important to be fair and accurate. Some teachers are in fact NOT fully implementing work-to-rule within their classrooms. Some school principals are working hard to minimize the impacts of work-to-rule. We want to acknowledge them. We are grateful to these wonderful people who care about the quality of their work, their students, and their students’ education.

Still, work-to-rule is hurting our students. It is hurting their education. It is unnecessary. The salary negotiation is moving forward to mediation anyway.

We, the people who sign this petition, respectfully request FUDTA to stop work-to-rule, and the Fremont School Board to take all necessary steps, with or without agreeing to a salary increase, to protect our students and their education. Our students and their education should not suffer because the adults can not come to an agreement. Please do not involve the students and their education in employee compensation negotiations.
