Sergio Nieto, a husband, father of four, and a lawful permanent resident faces removal from the United States. He legally came to the United States at five years old and has lived here ever since. He obtained his permeant residency in 1990 and is now at risk of being deported to Mexico, a country he no longer knows. He has lived in the United States for forty-one years and has lived here as a permanent resident for sixteen years. The reason that he is being detained is for minor felonies that were committed in the year 2000 and 2001. He completed probation and served his time for the crimes he did. He has then become a respected, educated, and hardworking individual. He learned from his mistakes and works hard every day to make his wife and children proud. He graduated from Laredo Community College in 2003, graduated from the Universal Technical Institute in 2004, and worked hard to obtain his Automotive Service Excellence Master Automotive Technician in 2017. His family and friends respect him and are proud of the man he has become.

Mr. Nieto and his family believed all was well since these felonies would not come out when Mr. Nieto would renew his residency in 2010, renew his driver’s license, or when stopped by police for minor traffic stops. Mr. Nieto and his family’s lifechanged dramatically when he and his wife returned from a trip they took to Mexico. Upon entering the United States, he was detained by customs for the minor felonies that happened years back. He was taken away without any proper explanation to his wife. Mr. Nieto is now being kept in the detention center and cannot be released by bond because of the pandemic. During this time ICE officers are taking the opportunity to intimidate Mr. Nieto to sign the I-407 document, the record of abandonment of lawful permanent resident status. He has no plans of signing his rights away, but his family is afraid that he will be intimidated to do so. He has always had the proper documents during the forty-one years that he has been in the United States, yet they want to remove his residency for felonies that were committed a long time ago. Mr. Nieto is the head of the household and during these troubling times of the Covid-19 pandemic, his family needs him. His family is worried for his well-being and wish for him to come back home.

By signing below, we will ask those who are overseeing Sergio Nieto’s case to consider the person that Mr. Nieto is today. He learned from his mistakes, poses no threat to the community, is respected by many, and has established a life here with his family. We ask for them to consider that he was never in the United States illegally and that he served his criminal sentence. Lastly, we as ask for Mr. Nieto to be released from where he is being held and cancel his removal so he may return to his family.
