On September 29 th 2008, the Honorable Judge Meryl Berkowitz and District Attorney Madeline Singas of Nassau County, Put an innocent Black man in Prison for life.  Ricardo Marsden has unlawfully spent close to 14 years in prison for a crime SCIENCE has proven did not commit. As of March 3rd 2021 the Honorable Judge Meryl Berkowitz denied motion 440 for a hearing, with new evidence proving his innocence . Before being WRONGFULLY CONVICTED, he was your average teenager driven, enthusiastic, and eager to explore the world. A few days after turning 18 yrs. old, he was snatched off the streets by Nassau County detectives. He was later confined to a room where he was beaten and interrogated for the better part of 23 hours. Despite this traumatic experience he WOULD NOT  CONFESS to a crime he didn’t commit. He was later charged with MURDER in the second degree and detained in Nassau County jail. Prior to his conviction Ricardo was given an unfair trial where The Honorable Meryl Berkowitz, sat by while the agents of the court miscarried it. October 1, 2019,  documents and  Court files have were moved before the Supreme Court Nassau County, for an order Vacating the judgment and dismissing the indictment and/or granting a new trial pursuant to Criminal Procedure Law § 440.10 on the grounds that: Ricardo Marsden is actually innocent and his continued incarceration is based upon a conviction of crimes he did not commit. Note This case violates the New York State Constitution and Federal Constitution.  In Mr. Marsden’s case A fraud upon the court changed the entire dynamic of the trial, which was presented by Detective Scott Kovar, Dr. Tamara Bloom and Dr. Brian O’Reilly.  A testimony was elicited: by Det. Kovar with junk science stating that Marsden’s boots had four months of wear on them, depicting a picture that the boots found on Marsden would allegedly be the footprints found at the scene of the crime.  Dr. Bloom and Dr. O’Reilly falsely testified about the deceased death.  As a result, Mr. Marsden’s right to due process was violated when compared with the lack of drug, ballistic and forensic evidence left at the scene. The People destroyed evidence, specifically the pot of food that was cooking on the stove in the deceased home, that would have provided critical evidence relating to the time of death of the deceased. Mr. Marsden had Ineffective assistance of counsel on the grounds that trial counsel failed to call a forensic expert to refute false testimony. The court failed to move for a trial order of dismissal or to preclude the statements allegedly made by Marsden, they failed to call a forensic expert and the cumulative effect of the due process violations.  America is now seeing the other side to this “Criminal Just-us- system “where innocent men and women are being exonerated for crimes, they have spent decades in prison for. In an Era where Criminal justice is a topic for reform where Meek Mill, Jay- z and countless others are speaking out, we all have an obligation to step up whether you are directly or indirectly affected. MASS INCARCERATION is GENERATIONAL GENOCIDE!  As unique as the circumstances are, there are countless men and women that are in prison today for crimes they did not commit. We must therefore support these individuals on a case by case basis as we tackle the bigger issues of re-Entry and Reform. Signing this petition help push council to use their executive power to free Ricardo Marsden, returning him back to his loving family. While Ricardo has been incarcerated her has been actively involved in Osborne association which is a partnership with individuals, families, and communities to create opportunities for people affected by the criminal justice system to further develop their strengths, and lead lives of responsibility and contribution. He is also a member of Exodus transitional community which is a Program that seeks to address the barriers justice-involved people experience when seeking employment. Ricardo has also earned his certificate of merit for legal studies and is currently an Honors student at Bard University. All in all, Ricardo Marsden has taken the necessary steps to contributing back to his community, to ultimately become the husband, father, son and brother he never got a chance to be.
