Horace "Boogie" Hampton has been wrongly convicted and sitting in prison for the last 16+ years. From the start of his arrest to the end of his trial his Due Process and Constitutional rights have been violated. Horacechas a stranger identification meaning, the witness didn't know him or ever seen him before. The witness testified at trial that when she pick Boogie out of the line up he was the only one sitting down while the rest were standing. The trial prosecutor was present with her when she made the ID. This is a witness who received $31,000 from the Manhattan D.A's office. She is also the only witness to put a gun in Horace's hand. Boogie was charged and convicted of Murder and attempted murder in this trial even though the surviving victim testifiedhe didn't see Boogie nor did Boogie shoot him. There was another witness with the murder victim that testified that he also didn't see him and Boogie did not kill jis friend. A 911 caller testified she saw the shooting from her car and the shooter walked past her but she did not see his face. Being that the testimony from the paid witness was weak, the DA put his CI on the stand who testified that he saw Boogie and victim talking in store before the shots rang and the Boogie walked past Jim. This witness is a 30+ year heroin and crack addict facing other charges. This witness has since recanted his statement saying he told them what they wanted him to say.
Horace got an expert witness to read the transcripts of the trial plus the written and grand jury statement. In the summer of'21, Boogie had an evidentiary hearing where the DA's informer stated he didn't know about the murder until the next day when the DA told him about it. He testified the DA was upset with him for not helping him on a different case and was going to have his family evicted from housing, so he told them what they wanted to hear even though it wasn't true.
The identification expert witness, a professor at Columbia University Law, testified about the paid witness ID. She said that this was a really ergarious set of facts from what she reviewed. She reviews a lot of cases but doesn't always testify because some are not warranted. But, looking at this case you have a trfecta. There are so many variables that limit the ability to encod and then recreated a suggestiveenvironment at the time of retrieval that can form the opinion that the procedure was grossly unfair given the witness conditions that would likely lead to mistaken identity.
The trial prosecutor testified at the evidentiary hearing that he put his informer on the stand at the grand jury and on trial to secure a conviction. He said he didn't know if the witness was lying or not, only the witness would know. When the Judge heard this warning signs should have went up. The only witness to put a gun in his hand was paid $31,000 by the DA's office and the only other witness to identify was a few decades long junkie who has since recanted his statement.
