It’s no secret that Texas is notorious for mass incarceration, leads the nation in executions as well as exoneration of the wrongfully convicted. If history records only one person who has been wrongfully convicted, that’s one too many. But in the last 30 years more than 2,000 of our loved ones has fallen victim to this injustice. For years we’ve known this problem exist. But what’s the solution?
My name is Antonio D. Chimney (cause # 9640). I was arrested on NOV. 25th,1995 for shooting 3 persons (T. Byrd , C. Owens, and M. Sanches).M . Sanches was the only surviving victim. At trial I was acquitted of the murder of C. Owens and found guilty of the murder T.Byrd.The M. Sanches charge simply faded away;which was strange because after all , she was the only surviving victim. If I was responsible for shooting her , how easily it would have been for her to positively identify me at my trial.But she was never called to my trial.Why,?it’s not hard at all to figure out. We all know that if M.Sanches had accused me of shooting her she would have been the state star witness! So again, why wasn’t the only surviving victim called to testify against me? Makes you wonder . What’s most unjust about my situation is , for nearly the entire time I’ve been incarcerated, Madison country Prosecutors have known of my innocence.I began serving life in prison on NOV. 19th,1996. Pay close attention to the date. On April 21St 1998, in open court before judge McAdams and Madison county District Attorney R. Montgomery, in a ‘Request to Consider Unadjudicated Offenses’, Rashan G.Perry confessed to the murder of (T.Byrd, C.Owens and the shooting of M.Sanches-cause # ‘s 9750, 9740 and 9762). Were we charged with the law of parties?No. So why am I still in prison? Better yet , when Mr Perry admitted his guilt before the D.A. , why wasn’t I exonerated of all charges? After all Mr Perry had just confessed to all of them.
This petition is to shed light on yet another Texas injustice and a call for the Madison county D.A. to step up and correct this injustice. This petition is not an attempt to solicit funds. The innocent should not have to pay for justice. Sign this petition and pass it on , please.
