Why this petition matters

Started by Shelby lynn Adkins

Hello, my name is David Wright. I am an inmate at James T. Vaughn Corrections Center. I am 56 years old and currently doing a sentence of 74 years. I was sentenced in 2008 under the habitual offender law and have been incarcerated for 14 years. My convictions consist of 5 charges stemming from one crime in which i received the maximum sentence for each charge: Robbery 1st degree( 25 years), possession of a firearm by a person prohibited( 15 years), Possession of a firearm during the commission of a felony (25 years), Kidnapping 2nd degree( 8 years), wearing a disguise (1 year). All of the charges listed are first time offenses, my prior convictions which were used to declare me a habitual offender and enhance my sentence consist of mostly lower grade felonies, property crimes; some going  back 30+ years. In 2016 I was informed by the public defenders office that my case was going to be used as part of its litigation arguments in an attempt to reform the habitual offender sentence guidelines and although progress was achieved, unfortunately many of the changes made no affect directly on my sentencing. In 2019 I was assessed by the Department of Corrections and it was determined that I have a 85% probability to not reoffend if released. I have well exceeded the mandatory incarceration that these charges carry for first offenses. If not for the unfair disparity of my sentence I would have been afforded the opportunity to live again as a free man and not be a burden on the system. I humbly as you to sign this petition which will be presented to the state courts and politicians in hope that they will see that although some advances and corrections have been made to correct the injustices of the past, there is still plenty to do in sentencing reform. I thank you in advance for your signature and comments.

Humbly,

David Wright
