Sophie Alexandra Bertrand, 17 years old, had her entire life ahead of her. Her life was taken away, just  by being an innocent passenger in a vehicle driven by a driver whom  admitted to the police, that she (operator of vehicle )  had  taken illegal SCHEDULED NARCOTICS SCHEDULE I,  RS 40:964, the morning of the accident. The operator of the vehicle also admitted to taking the same type of drugs the night before the accident.  

 

I AM PETITIONING FOR VICTIMS TO HAVE A VOICE!!!

 

I want the law changed.

I am petitioning for “Sophie’s Law” to come into fruition.

We, as citizens are Entitled to Justice

• DRUGGED MEANING : USING ILLEGAL NARCOTICS THAT ARE SCHEDULED I, II, III, IV OR V, AS WELL AS
• PRESCRIBED DRUGS TAKEN INCORRECTLY OR THAT CAUSE NOTICEABLE SIDE EFFECTS SUCH AS BLURRED VISION, DIZZINESS, AND DROWSINESS, OR ANY EFFECT THAT CAUSES OPERATOR TO FEEL DIFFERENT OR KNOWINGLY KNOWS JUST NOT RIGHT TO DRIVE.

It clearly states under Louisiana RS:  14:32.1 the meaning of VEHICULAR HOMICIDE.  

The law states that if you, the operator of a vehicle or watercraft in Louisiana, while under the influence of 
Scheduled illegal narcotics I,II, III, IV OR V, and cause a {{FATAL CRASH}}, this is VEHICULAR HOMICIDE, as well as stating ::if while under the influence of alcohol and cause a fatal crash and your 
Blood Alcohol Content reads a .08 or higher, this is also VEHICULAR HOMICIDE. 

• THE GRAY AREA LIES WITHIN THE VERBIAGE, UNDER THE INFLUENCE.  THIS IS WHERE SOPHIE'S LAW COMES IN.  
• TO THE DEFENSE OF THE OPERATOR/DRIVER ONE WILL STATE IF B.A.C. IS .08 IT IS NO QUESTIONS ASKED, VEHICULAR HOMICIDE, DUE TO THAT BEING ABOVE THE LEGAL STATE LIMIT.
• NOW REMEMBER, SCHEDULED ILLEGAL NARCOTICS I, II, III, IV AND V ALSO CONSTITUTE UNDER THE INFLUENCE.
• THERE IS NO STATE LIMIT regarding a drug limit due to Louisiana not being A Per Se State.
• A GREAT EXAMPLE IS MARIJUANA, THIS IS A SCHEDULED ILLEGAL DRUG IN LOUISIANA.  THE DRUG CONTAINS THC, IT IS THE THC WHICH CAUSES ONE TO BE IMPAIRED / UNDER THE INFLUENCE, BUT IT LEAVES YOUR BLOOD STREAM WITHIN HOURS AND ENTERS INTO YOUR BRAIN AT A  CONCENTRATED LEVEL THAT CAN BE READ BY A SCAN., ( neuroimaging, ie: MRI, PET scan, and a CAT scan). ITS THE THC THAT CAUSES THE IMPAIRMENT.   BUT IF YOU HAVE MARIJUANA IN YOUR BLOOD THEN IMAGINE HOW MUCH IS IN YOUR BRAIN. 
• WITH THAT BEING SAID, TIMING OF THE DRUG TEST, AT THE TIME OF A FATAL CRASH, IS A CRITICAL WINDOW OF GETTING THE MOST ACCURATE RESULTS. The law already states you must take a drug test at a fatality scene, if not feasible you have up to two hours to get this done)
• A PERSON OF NORMAL SIZE MALE OR FEMALE, FACES A .15 DROP IN THEIR B.A.C. LEVEL, AT MINIMUM PER HOUR.  SO IF ALCOHOL DROPS 0.15%per hour in your blood.
• NOT ALL LOUISIANA POLICE ARE D.R.E. CERTIFIED AND SHOULD HAVE ONE ON SITE WITHIN AN HOUR OF A FATALITY. 

SOPHIE'S OPERATOR DID NOT HAVE THEIR DRUG TEST  TAKEN UNTIL 7 HOURS LATER, MEANING THOSE DRUGS THAT LEAVE BLOOD TO ENTER BRAIN ARE REGISTERING ON THE TOXIOLOGY.  THIS IN ITSELF IS A HUGE INJUSTICE TO SOPHIE!!

SCHEDULED DRUGS I, II, III,IV, AND V ARE DANGEROUS, HARMFUL DRUGS, OR THEY WOULD NOT BE ON THE NATIONAL DRUG LIST AS SUCH.  THESE INCLUDE MANY TYPES, SUCH AS MARIJUANA, ECSTACY, HALLUCINIGENICS,  MOLLY, XANAX, COCAINE, METHAMPHETAMINE, I COULD GO ON, BUT YOU CAN FIND THE ENTIRE LIST UNDER THE NATIONAL SCHEDULED DRUG LIST. 

• THE POINT BEING, IF YOU ARE TAKING, ECSTACY, THEN YOU ARE UNDER THE INFLUENCE AT ANY DETECTED LEVEL DUE TO THE LEAVING BLOOD TO BRAIN AFFECT, CAUSING, EUPHORIA, ELEVATED FEELINGS OF ONE SELF, HEARING SOUNDS IN A MUCH LOUDER TONE THAN ARE ACTUALLY BEING PLAYED, HYPERSENSATIVITY, AND DEPTH AND BLURRED OR CROSSED VISION, IT ALSO CAUSES ONE TO PANIC AS THEY CANT CATCH THEIR BREATH DUE TO THE AMPHETIMINE COMPONENTS, CAUSING PANIC WHILE DRIVING IS VERY DANGEROUS,  AND IT CAUSES ONE TO STAY UP FOR HOURS, AND SOME EVEN DAYS. IT IS A HALLUCIGENIC AS WELL.  THIS IS JUST ONE EXAMPLE OF ONE DRUG.  MOST SCHEDULED DRUG USERS ARE POLYUSERS, MEANING SMOKE MARIJUANA AND TAKE ECSTACY, ETC.. OR USE DRUGS AND DRINK ALCOHOL. 

ALL KNOWN SIDE EFFECTS OF SCHEDULED ILLEGAL NARCOTICS ARE DOCUMENTED , AS WELL AS STATING EACH INDIVIDUAL CAN ACTUALLY HAVE ADVERSE OR MORE EFFECTS. 

WE LIVE IN A " DONT DRINK AND DRIVE"   "DONT TEXT AND DRIVE " STATE.

THERE ARE BILLBOARDS SHOWING CERTAIN DRUGS, SUCH AS FENTANYL, BUT I HAVE YET TO SEE ONE THAT states

”Drugged drivers KILL”

Our state has many drunk driving statistics, due to the fact we can test on the roadside and get an almost immediate B.A.C. READ, but we fail to realize there is also other components to the impaired driving test, such as the nystagmus  test, ( this is the  eye movement test, ) as well as the stand on one leg and also walk a straight line test.  They are just as relevant as the reading.  If one can not walk straight, this is a clue to an officer to look into this person more thouroughly.  SOPHIE'S DRIVER MISSED STEPS. Another Injustice to her perishing under this crash. 

Having a D.R.E. Would constitute an immediate determination of impairment., along with the chemical test and sobriety test it’s weight in court is tremendous.

This petition is for Sophie Alexandra Bertrand, born on April 15, 2003  7lbs 8oz  21 1/2 inches long, and Died at the age of 17, 2 months short of her 18th birthday, the birthday I heard about for 6 months. 

#SOPHIE'S LAW#. It’s a must, not an option.

I want everyone to be able to drive or ride without the fear of Death on our roads, due to preventable causes.  I was a year away to my High School Graduation.  I looked forward to becoming a travel nurse and maybe getting a part time job at Sam's.  I talked to my mom about many of my dreams the night before this day I was taken away from my life.  I will never get married, or have kids, I'll never have another ride with my mom, or a quick visit with a friend.  I am gone forever from my love one's sight. If I can tell you one thing, it is to call your district attorney and let him know I wanted to live, I am the the victim here.   So due to the fact that I can not be heard, please, please speak for me. I want to know that in the end I helped at least one person Live the Life I was denied.

 

If our legal system took drugged driving more serious, and bring about the correct charges, and hold the guilty accountable., our roads would decline in drugged driving fatal statistics.  

The excuse of levels in toxicology are a diversion of FACT!
