The Farm Bill of 2018, which passed in December and was signed by President Trump, federally legalized hemp (and CBD) by officially removing it as a Schedule 1 substance. However, there are warring factions within our government; not one day after hemp and CBD were legalized, the FDA issued a statement that hemp CBD, while legal under The Farm Bill, is still not an approved food or cosmetic ingredient. 

This has left states, retailers, and consumers incredibly confused on the legality of CBD. Moreover, local health departments are beginning to announce their own, uneducated positions on CBD. For example, Maine's DOH has stated that CBD is allowed be smoked, but that it is not allowed in foods (Can anyone explain how in the world smoking something is 'healthier' for you than eating something?) Without immediate guidance from the FDA, local health departments could actually be doing more harm than good.

The World Health Organization (WHO) recently announced that they would like to clarify that CBD and CBD-focused preparations containing no more than 0.2 percent THC are "not under international control" at all. "To date, there is no evidence of recreational use of CBD or any public health related problems associated with the use of pure CBD," they wrote. 

Why is the FDA behind?

Millions of people across the United States currently take CBD to help them manage their pain and anxiety as a natural alternative to incredibly damaging and addictive opioids, and other manufactured drugs.

To be clear, we are NOT asking that the FDA simply allow all CBD products to flood the market.

We ARE asking the FDA to update their position on this subject immediately (not 12-18 months from now) and put a process in place to regulate CBD so that consumers are able to safely purchase CBD from reputable brands.
