RE: Written comments in response to rulemaking workshop for Rules 61A-3.054 and 61A-3.055

 

Dear Director Philpot,

 

            On behalf of the Florida Indep. Liquour Store Owners Associations(FILSOA), independent liquor store operators are members across the state, thank you for holding a rule workshop on September 27, 2018 in Ft. Lauderdale regarding Rules 61A-3.054 (“Party Supply Rule”) and Rule 61A-3.055 (“Restaurant Rule”). It is our understanding that the parties asking you to repeal the Restaurant Rule did not show up to this workshop. Regardless, we wish to offer the following written comments to make clear how important these rules are to our business and the liquor industry as a whole.

            As small business owners in a highly-regulated industry, it is essential that we receive clear and unambiguous guidance from the state as to what items we may sell. Our many Division-issued licenses and our reputations in the community are too important for us to simply guess what the Division considers to be “party supplies” or “items customarily sold in a restaurant.” These rules have provided this necessary guidance for decades. Such clarity allows us to reinvest in our businesses and communities with confidence. If these rules are repealed, then we will be placed in a perilous position that will harm our businesses going forward.

            Further, the demand to repeal either or both of these rules is nothing but a thinly-veiled, backdoor attempt to implement the “Whiskey and Wheaties” legislation that the Governor vetoed in 2017. Those pushing such repeal have made clear that their intent is to accomplish exactly what the Governor sought to prevent: selling liquor in their main stores alongside other items. After several legislative sessions, hundreds of hours spent debating such legislation, and millions spent on lobbying for these efforts, these parties now claim that none of that was even necessary. That is absurd. Without question, this is an issue that the legislature must address. However, this attempt to go around the process altogether is inappropriate.

            We would respectfully request that you leave the Party Supply Rule and Restaurant Rule in place unchanged. By doing so, the Division will continue to provide sufficient guidance to the industry and to give effect to the pertinent Florida statutes. Once again, we thank you for your time and attention to this matter, and we look forward to working with you as our family businesses serve Florida customers for years to come.
