¿Qué está ocurriendo? ¿VES INJUSTICIAS Y NO PUEDES HABLAR? Si hablas te imputan y te intentan convertir en delincuente. No porque lo que hayas hecho sea delito, sino que hacen que esos hechos, según su interpretación, sean delito.

Eso es lo que le está ocurriendo a nuestro compañero el letrado Gabriel Ruiz García que está imputado por un delito de injurias contra funcionarios con publicidad por la Fiscalía de Alicante por las opiniones vertidas y publicadas en la página web de la Asociación Justicia Para Todos www.justiciaparatodos.org concretamente, sobre el llamado Caso Negur.

El letrado Gabriel Ruiz García fue citado a declarar en el Juzgado de Instrucción Nº 2 de Cervera de Pisuerga (Palencia) el día 4 de marzo de 2015 a la 10:00 h.

A fecha de hoy, 18 de septiembre de 2016, la instrucción del caso sigue adelante por parte de la Fiscalía de Alicante y estamos a la espera del escrito de acusación del fiscal.

Analizando los fundamentos en los cuales se basa la imputación (leer imputación) por el delito de injurias contra funcionarios con publicidad se puede comprobar que no hay ninguna base para realizar dicha imputación, leyendo lo publicado en la página web Justicia Para Todos  - Caso Negur  podemos ver que se trata de “una mera descripción de unos hechos que no tienen explicación”. Lo que pide el letrado Gabriel Ruiz es que se explique el comportamiento habido durante todo el procedimiento por parte del ministerio fiscal, juez y jueces instructores para determinar si los hechos descritos en la querella tenían fundamento o no.

Nos lleva a pensar ¿qué está ocurriendo?, que nos expliquen por qué no se ha llevado a cabo el interrogatorio a los testigos propuestos por el letrado Gabriel Ruiz en los distintos autos y recursos presentados ¿Por qué no se ha realizado la investigación pertinente? ¡SE LES PIDE EXPLICACIONES, NO SE LES ACUSA!

“Nos encontramos ante un caso más de injusticia"

"El juzgado de Instrucción nº 2 de Benidorm y la Audiencia Provincial de Alicante han archivado una querella por apropiación indebida y estafa sin haber realizado la más mínima investigación sobre el caso. La archivan sin fundamento alguno. Tanto la representación del Ministerio Fiscal, la Jueza de Instrucción y los Magistrados de la Audiencia Provincial de Alicante no han realizado una investigación sobre lo sucedido. Me atrevo a afirmar que no se han leído el sumario. Si se lo hubieran leído no hubieran dictado los Autos de sobreseimiento. La querella fue presentada a principios del año 2008. Se ha ido dilatando en el tiempo hasta que dictan los Autos de sobreseimiento. Lo curioso es que aunque no lo hubieran sobreseído, nada se hubiera podido hacer porque hubiera prescrito por haber transcurrido todo este tiempo desde que se produjeron los hechos. No se puede entender esta dilación, desde principios de 2008 hasta 2014. No se puede entender salvo que hayan existido influencias en los jueces y el Ministerio fiscal para que el caso se archivase o prescribiese. Publicamos la querella, recursos y los Autos de sobreseimiento del juzgado nº 2 de Benidorm y de la Audiencia Provincial de Alicante.”
