GST act was implemented in 2017, a time when MSMEs were already  trying to recover from losses due to demonetization. Due to complex compliance structure of GST, most of the MSMEs were unable to comply and file their returns timely. GST department has now started suo motto cancellations of all such MSMEs, which have made these MSMEs an illegal entity. They can't raise Tax Invoices and hence are on the verge of closing their businesses. Biggest reason of non compliance is monthly penal provision which can be as high as Rs.10000.00 per month and such penalty is greater than the tax due in most of the cases. Shutting business of such MSMEs (approx 10lacs) will be huge dent on economy as MSMEs provide employment to unorganized & unskilled people. Government has provided support to Corporates, Telecom Sector, Builders & Banks, but no support has been provided to MSMEs, who are managing their business on their own. Our appeal to Government of India is to restore such cancelled GST, provide them ample time to comply (deadline of 3-6 months) and waive off the penalty so that these MSMEs don't switch to unorganized business or worse end their lives due to guilt of being treated as criminal.
