Fernando Mendoza Hernandez (A#205324527): RELEASE DACA-ELIGIBLE DREAMer FROM DETENTION NOW!

PLEASE SIGN THIS PETITION NOW TO TELL ICE AGENTS TO RELEASE FERNANDO MENDOZA HERNANDEZ (A#205324527) AS HE QUALIFIES FOR DACA.

 

On June 15, 2012 President Barack Obama set forth a policy called Deferred Action for Childhood Arrivals (DACA) instructing ICE agents to halt the deportation of undocumented youth brought to the U.S. as children who meet certain criteria. Despite the new policy, DACA-eligible youth, Fernando Mendoza Hernandez (A#205324527) was arrested by a Salt Lake City ICE agent Briggs on November 28, 2012. Fernando is currently convicted with a Class C misdemeanor for disorderly conduct, a charge that would not disqualify him from DACA.

A father of two U.S.-born children, Fernando, 21, is an active and contributing member of his community. Fernando is a current member of San Andres Catholic Church in Payson and a former member of Notre Dame de Lourdes Catholic Church in Price, Utah. Fernando is currently enrolled in a GED program offered by Lighthouse Learning Center and is only one credit-shy of obtaining his GED. Fernando, who is originally from Mexico City, has resided in the United States since the age of 15 and considers the U.S. his only home.

Fernando's family has spoken with an immigration attorney who has told them he is eligible for DACA, yet he remains in the Utah County Facility in Spanish Fork. Fernando has been threatened by ICE agent Briggs to be deported and has been told he “has no hope.” He has also been interrogated and is being pressured by ICE agents to sign an order of deportation. Fernando's bail was set at $5,000 but has since been doubled for no reason. His family has struggled to obtain pertinent information concerning his arrest because ICE agents have been uncooperative to their requests.
