Legalize Kinder Surprise Eggs in the United States

In 1938, the Food, Drug, and Cosmetic Act was passed in the US. This banned any food that had any non nutritive objects inside. Kinder Eggs were one of them since there is a toy inside.
I was born in Europe and I have been there many times. I'm always given Kinder Eggs when I go there and they are one of my favorite chocolates. When I was younger I was always excited for getting the toy in the middle. Just recently I've been trying to find them here but I couldn't. I asked my dad why I couldn't find them anywhere and he said they were illegal because of the toy inside. In my opinion I believe it is the parents' responsibility to watch over the children, not the government. There are also labels that clearly state that there is a toy inside and it can create a choking hazard for young children. The parents should tell their children that there's a toy inside so they don't choke on it. If it's a small child then the parent should open it for them. This is a parents' responsibility to make sure they don't choke on it. They shouldn't have to be banned because a few irresponsible parents weren't watching their young children. I also believe that since it is America, we should have the right to choose what we want to eat, and not have people tell us what not to eat. I only go to Europe every couple years with my family, which means I can only enjoy Kinder Eggs every couple years. I would love to see them in the stores here in the US so that way American children can enjoy eating Kinder Eggs and enjoy getting the small toy in the middle.
