Expel and Terminate Andy Switzer as City's "Zoning" Inspector

The Issue

As concerned residents of Union, we are deeply troubled by the actions and behavior of Andy Switzer, who currently holds the position of the city's "zoning" inspector. We firmly believe that this position should be an elected one, chosen by the residents themselves. It is time for us to come together and demand that City Council takes immediate action to expel and terminate Andy Switzer from his appointed position.

This petition is personal to me because I have personally experienced the negative impact of Andy Switzer's abuse of power. Not only does he exhibit a power trip mentality, but he also engages in bullying tactics against residents who live in Union. His actions go beyond what is acceptable for someone of his position.

Furthermore, many residents have seen and reported to the city of Andys stalking behavior. It has also been reported many times that Mr. Switzer obtains illegal images by targeting homes and their attached properties while supposedly "working" on other nearby homes under the guise of doing his "inspection" and uses them to issue citations. This includes taking photos from the roofs of homes he is inspecting, and additionally PEEKING over the privacy fences of other properties. This a clear violation of privacy rights and an infringement upon our 4th Amendment protections as Americans. This behavior cannot be tolerated any longer. 


Pursuant to the fourth amendment to the United States Constitution, a township zoning inspector may not enter and inspect private property without a search warrant where the owner or occupant of the property does not give consent, unless there is an emergency, the property is open to the public, or the industry conducted on the property has a history of government oversight such that no reasonable expectation of privacy exists. (1973 Op. Att'y Gen. No. 73-116, overruled, in part.)

2. A township zoning inspector is not a "law enforcement officer" under R.C. 2901.01(A)(11) or Ohio R. Crim. P. 2(J).

To support our demand for change, we would like to present some relevant facts:

1) The current system allows for an appointed zoning inspector without any direct accountability or oversight from the residents.
2) By making this position an elected one, we can place this position and ensure it to a qualified individual, who is a RESIDENT, and someone who truly understands the needs and concerns of Union's residents with this important role. 
3) Numerous instances have been reported where Mr. Switzer has displayed menacing behavior towards residents, creating an atmosphere of fear within our community.
4) The 9th Amendment guarantees certain unenumerated rights to citizens - these include privacy rights which are being violated by Mr. Switzer's actions.

We urge City Council members to take these facts into consideration when evaluating this petition. It is time for them to listen to their constituents' voices and act accordingly.

In conclusion, we, the residents of Union, demand that City Council expel and terminate Andy Switzer from his position as the city's "zoning" inspector. We further request that this position be transformed into an elected one, allowing for direct representation and accountability to the residents of Union. It is time for a change in leadership that prioritizes respect, fairness, and adherence to our constitutional rights.
