Barry Evans attended Escambia High School his Freshman Year, at the age of 15 his English Teacher had a sexual relqtionship with him. The teacher was  charged for the crime, however , she was aquitted at trial because she had. Her written and recorded admission of guilt suptessed because she was not read her maranda rights. The other factor was Barry Evans , who was only 15, did not see their relationship as criminal declined to get on the stand and tesify . The teachers name is Moniqua.Veasey, although the school she was employed at and Barry attended was in Pensacola FLorida , she was charged in Baldwin County Alabama  becaise she traveled to Alabama with Barry on the occasions they were sexually involved. Within months of the teacher relationship being expoaed., Barry became depressed and was hanging out with new friends that introduced him to criminal ways to make dast money. At 16 he was arrestes for three nights of entering unlocked unoccupies vehicles and atealing valuables inside of the cars. There were 7 cars he qas charged with. The state stacked up over 20 felony charges and immediately trqnsferred his cases from juvenile court to adult court. He was senteced on 27 felonies , now a permant part of his adult criminal record at the age of 16. He was senteced to serve 11 months 15 days in the Eacambia County Jail, with 5 years felony probation to follow. He served the time in jail and successfully served 4 1/2 years of the probation , worked and paid all court fines , paid all his restitution and had completed all of his community service. He was doing great , working in the kitchen as a cook at the Shrimp Basket , then he had a set back. His live in girlfriend emptied his home of everything he had worked for while he was at work. He became very depressed , started doing a variety of street drugs. This went on aprox 2 weeks....then while going to a so called friends to give them a ride ...police officers came up on him , searched him and his car and found the drugs he was had for personal use. To make matters worse his Mom had borrowed his car the night prior and left her hand gun under the drivers seat. Barrys mom testified the gun belonged to her at depositions , however, the state refused to drop the gun charge. The state also charged Barry with trafficing for 5 loratab pills . The person who left the 5 loratabs inside his pill bottle in Barrys car testified at depositions they belonged to him. The state dropped the charge for the 5 loratab pills but added the trafficing on a liquid form of loratab found inside his car, a lesser amount than the 5 pills .Barry felt defeated to sign a plea that convicted him for the possesion of a gun he was unaware was inside his car, a plea agreement convicting him of trafficing drugs that were in his possesion for personal use. Trafficing drugs is a serious crime and BARRY IS NOT GUILTY OF THE CRIME. He was told that if he lost at trial he would get 15 years prison for violating probation. Fear of that is what led hik to sign the plea. He is currently serving a 85 year prison sentence, however , the Judge ran his time concerant with 7 years. Upon release he is orderr to pay 100,00 fine , which will gain interest as he serves his time. He was 21 years old when he was arrested on the cchargeshe is currently serving a sevem year prison sentenc for, Barry is now 22 years old. I pray that Barrys sentence be commuted as follows , take away the trafficing charge and reduce it to possesion to be accurate to his guilt, relieving him of the 100, 000 fine which would be almost impossible foe him to pay, and shortn his prison sentence to 3 years and an in house 18 month drug rehabilitation program he was screened for and accepted for, pathway to change located in Escambia County Florida. Barry was never offered any help coping with what happened his freshman year in high school with his English teacher , the one year in adult jail tool him out of public school and his outlook on authority became distorted making him believe authority didnt apply to him considering an authority figure who he was influenced by was having sex with him at the age of 15, he was easily led into criminal behavior , the semtence he was given denied him a downward departure he was eligible for based on his age of the crimes that had him on probation and his inability to comprehend the fullness of the efect his actions had on the victims , he was denied the privilege and positive benefit of a wonderful prison alternative program he was screened for an acceptes in to, pathway for change. A 18 month in house faith based drug rehabilitation that has an aweaome track record of success with only a low number of inmates completeing the program reoffemding , a recora of 80 percent lower reoffenders than that of prison inmates. Only a few of tha many inmates screened for Pathway for Change are accepeted. The ones accepted are chosen based on their need for drug use rehabilitation and if they fit their criteria of bpredictable success through the extemsive program. Barry Evans is non violent inmate , he admita and takes reaponsibility for hia guilt . Barry is remorsful and wants to better himsellf and he desirea the support of a program like Pathway for Change and is eager to learm coping and tools to stay away and clean of druga once released back in tp society.
