APPLY FOR REVISING THE PARIS AGREEMENT

Dear :

Mr. President of the United States

I and the undersigned signatories represent

- Vietnamese Americans in the United States

- Overseas Vietnamese in other countries around the world

- 90 million people live in Vietnam.

 

This application respectfully begs the President to preside over justice for our people, revising the Paris Agreement, which is

 

AGREEMENT ON ENDING THE WAR AND RESTORING PEACE IN VIET-NAM

 

Of which the United States represents the Republic of Vietnam signed with the People's Democratic Republic of Vietnam (North Vietnam) In order to end the war, restore peace in Vietnam on the basis of respect for national rights. Basic of the Vietnamese people and self determination of the people of South Vietnam, contributing to the cause of peace in Asia and the world.

 

Dear President

According to the Paris Agreement, Articles 1 to 8 stipulate the cease - fire, the return of prisoners of war and civilian personnel between the two parties. Article 9 states that:

Chapter IV

Article 9

The Government of the Democratic Republic of Vietnam and the Government of the United States pledge to respect the following principles of self-determination of the people of South Vietnam:

A) The South Vietnamese people's self-determination is sacred, inviolable, and respected by all nations.

(B) The people of South Viet Nam themselves determine the political future of South Vietnam through a truly free and democratic international election.

C) Foreigners shall not impose any political or personal tendency on South Vietnam.

 

According to Chapter IV, Article 9 of the Paris Agreement, points (a) and (b), the right of self determination of the people of South Vietnam (the Republic of Vietnam) is sacred, inviolable.

 

And: The people of South Vietnam (the Republic of Vietnam) decide themselves the political future of South Vietnam through free and democratic elections, with international scrutiny.

 

Two points (a) and (b) have not been implemented.

 

Regarding point (c): "Foreigners must not impose any political or personal tendency on the people of South Vietnam."

 

For the people of "South Vietnam" (the Republic of Vietnam) all other countries are foreign, including "Democratic Republic of Vietnam (North Vietnam)".

 

These countries have pledged not to impose political tendencies (like socialism) or individual trends (such as Ho Chi Minh) on the people of "South Vietnam."

 

But the "Democratic Republic of Vietnam (North Vietnam)" used force to occupy "South Vietnam", and imposed the socialist political system on "South Vietnam". This is in violation of subparagraph (c), Article 9, Chapter IV of the Paris Agreement.

 

CHAPTER IV,

Article 11

Immediately after the ceasefire, the two sides of Vietnam will:

 

To carry out harmony and national reconciliation , to abolish all hostilities, to prohibit any acts of retaliation and discrimination against individuals or organizations that have cooperated with one party or the other.

- Ensuring the democratic freedoms of the people:

* Personal freedom,

* Freedom of speech,

* Press freedom,

* Freedom of assembly,

* Freedom of organization,

* Freedom of political action,

* Freedom of Religion,

* Freedom of movement,

* Freedom of residence.

* Freedom to live,

* Property rights

* Freedom of business.

 

- The issue of " harmony and national reconciliation, the elimination of all hostilities, the prohibition of all acts of retaliation and discrimination against individuals or organizations that have cooperated with one party or the other."

 

The Democratic Republic of Vietnam (CS North Vietnam) does not respect. They forced all ARVN soldiers and civil servants to study rehabilitation (in fact, forced labor) in places where the forest was sucked, with no minimum facilities (no electricity, water, medicine, house Where, and bed ) are all made by prisoners themselves. During 3 years to more than a decade. (Many have died at the redevelopment site)

 

- About the Humain rights and freedoms: Most of these rights are not respected by: Democratic Vietnam, Republic (North Vietnam Communist) .

 

* Personal freedom: No, people are always controlled by local people and police.

* Freedom of speech: None.

* Press freedom: None

* Freedom of assembly: None (gathering more than 5 people must apply for permission)

* Organizational freedom: None, Only the Communist Party is the only party.

* Freedom of political action: None.

* Freedom of Religion: Violated (many temples, churches forced eviction)

* Freedom of travel: Yes.

* Freedom of residence: None, must be in a place of residence (or temporary residence with declaration)

* Freedom to do business: Yes, but not all jobs.

* Property Rights : Limited. (Because of state land)

* Freedom of business : Limited (There are no licensed jobs, eg electricity, gas, oil, currency)

 

In summary, North Vietnam communis does not perform harmony, national reconciliation, apply revenge policy to ARVN military personnel and officials.

People are not fully entitled to the rights recognized by international law (Human Rights)

 

Because of the partner country, the Democratic Republic of Vietnam did not comply with the Paris Agreement they had signed with the United States, causing a lot of injustice and suffering for our people. So we, include:

- Vietnamese Americans in the United States

- Overseas Vietnamese in other countries around the world

- 90 million people live in Vietnam.

 

Honor the President of the United States of America, the sponsor and the representative of the Republic of Vietnam to signed the Paris Agreement , to review the implementation of this agreement in the presence of the member countries of the treaty sponsoring council.
