The Prague Sanitary Office has filed a criminal complaint against 30 men who had unprotected sex though they knew they were HIV-positive, reported local media on 15 February 2016.
The men face up to ten years in prison for causing a serious bodily harm and spreading a contagious disease.

NO PERSON WITH HIV BELONGS IN PRISON FOR HAVING SEX. Anyone living with HIV with undetectable viral load while taking treatment will not transmit the virus.

This nonsense must stop immediately; it is both a grave violation of the fundamental rights of these persons, and completely counterproductive in the struggle against HIV/AIDS.

Representing the communities of people living with and affected by HIV in Europe, AIDS Action Europe, the European AIDS Treatment Group, the HIV Justice Network, the European Commission's Civil Society Forum on HIV/AIDS and the Network of Low Prevalence Countries have registered with a lot of concern and abjection that the police of the Czech Republic is conducting investigations and considering pressing charges against people living with HIV claiming that they have violated the provisions of Sections 152 and 153 of the Czech Criminal Code. The initiation of criminal prosecution against people living with HIV for intentional gross bodily harm raises concerns about the inappropriate application of criminal law.
