Aug 9, 2012 — Community Responds to EPA Over Aquifer Exemption and Uranium Mining
On June 27th the EPA sent this letter to the NMELC in response to client’s, Eastern Navajo Dine Against Uranium Mining (ENDAUM) request that the EPA reconsider the Churchrock aquifer exemption.
Basically, the letter says that if there are minerals (like uranium) in an aquifer and no one is currently drinking from the aquifer, EPA will issue an aquifer exemption. Even though the uranium is currently NOT POLLUTING the aquifer, the EPA will allow irrevocably polluting future drinking water supplies by allowing mining to go forward. See EPA’s letter.

ENDAUM responded with this letter to EPA Region 6 explaining why Region 6’s legal position with respect to the Churchrock aquifer exemption is wrong. See ENDAUM’s letter
