This past week New York State Police arrested the Gloversville mayor on an official misconduct charge a class a misdemeanor . Police say Dayton King used his position as mayor to access and review personal information on his opponent William Rowback in the race for mayor, who also happens to be a city employee. We're asking that you look into this and looking to have him resign his position as mayor
The law is the law. This is one of the few instances where the grey area is very slim. Dayton King does not have a lot of wiggle room. Dayton knowingly, intentionally, and illegally disseminated private, protected information.
Dayton’s story changed from total innocence (e.g., he did not do anything wrong/did not release private, protected information) to excusing his bad behavior because he allegedly felt pressured during a political debate.

195.00 Official misconduct.
A public servant is guilty of official misconduct when, with intent to
obtain a benefit or deprive another person of a benefit:
1. He commits an act relating to his office but constituting an
unauthorized exercise of his official functions, knowing that such act
is unauthorized; or
2. He knowingly refrains from performing a duty which is imposed upon
him by law or is clearly inherent in the nature of his office.
Official misconduct is a class A misdemeanor.
Section 10 (17) of the Penal Law defines benefit as any gain or advantage to the beneficiary and
includes any gain or advantage to a third person pursuant to the desire
or consent of the beneficiary.
