To the Florida congressional delegation:

We the undersigned join with the Florida LGBTQ Advisory Council in urging you to co-sponsor and pass the "Act Concerning Gay and Transgender Panic Defenses", to be filed in the 2020 regular legislative session.

The proposed bill provides that the discovery or knowledge that a victim is gay or transgender does not warrant justifiable use of force or excusable homicide in criminal defense cases.

So-called "gay panic defense"  is linked to a notorious 1954 case here in Florida, where two criminal defendants seduced, robbed, and murdered William T. Simpson, then claimed the victim's "unwanted advances" made them feel "unsafe". Their first-degree murder charges were downgraded to manslaughter convictions.

Similar defenses have since been employed in dozens of cases across the US, even as recently as 2018.

"Gay panic" and "trans panic" defenses reinforce and institutionalize prejudice at the expense of reasonable tolerance and self-control, undermining the legitimacy of criminal prosecutions.

Much has changed since 1954, and the state of Florida is more diverse than ever. We must end the antiquated notion that the lives of LGBT+ persons are worth less than the lives of others.
