We the citizens of the Commonwealth of Dominica are calling, through this petition, on the OECS Court to look expeditiously into an issue that is perpetuating a semblance of favoritism in our judicial system. The issue of judges and residency has become an issue of contention amongst our citizens as we have a judge - Justice Bernie Stephenson, who has been in residence in Dominica for over a decade. We sincerely believe that this is very irregular in the usual scheme of rotating judgeships in order to avoid at the very least, a perception of complicity and partiality in rulings and the judiciary. We implore the administration of the OECS COURT SYSTEM (ECSC) to treat our concerns with urgency, as further delay in this matter will significantly affect our perception of the courts and our respect for the judicial system administered regionally by your court. We eagerly await some concrete actions on this matter. 13 years is too long a period for any judge to be resident in any one jurisdiction.

We seek attention specifically to the following.

That public perception of the independence of the judiciary and their ability to function effectively within the constraints imposed by small size of communities within the jurisdiction is very critical to the mandate of the court.

We humbly suggest that judges should be guided by a public code of ethics and behavior, if one does not exist or is not public.

3/
We are strong supporters of the rule of law in our region and of the many judges and masters who daily try to dispense justice in our small scattered communities. We believe that a constant spirit of reform and willingness to listen to the public are vital for the effective viability of our judicial system and for the success of the region as whole.
