DoorDash is a national delivery service that utilizes independent contractors to deliver for them. In order to legally keep drivers as independent contractors, they must allow drivers to turn down offers that are unreasonable. For example, DoorDash might send an offer to pay a driver $3.50 to drive 17 miles out of town. When the driver declines this offer, they should never be penalized. DoorDash has found a work-around for this legal inconvenience with their “Top Dasher” program. If a delivery person’s acceptance rate falls below 70%, they are ineligible for this program. This would be perfectly okay if the program didn’t decrease earning opportunities for those drivers. Maybe they could offer a bonus or free food? But, the rewards given to “Top Dashers” are in effect punitive to those who do not meet this accceptance rate by decreasing order opportunities for those who are making the best decisions for their families. UberEats, Instacart, and GrubHub do not engage in this practice (at least that we are aware of). We ask that DoorDash discontinue giving top dashers and brand new drivers priority and provide all Dashers with equal earning opportunities.
